# Equipment Breakdown Insurance in West Virginia

Anyone operating a steam boiler over 15 pounds per square inch in West Virginia must first obtain a permit from the Commissioner of Labor, unless a listed exception applies. If an insurance company operating in the state inspects the boiler during a 12-month period, the Division of Labor does not also inspect it in that period. The Division's boiler rule covers high-pressure steam boilers and forced-flow steam generators, not low-pressure heating boilers.[^1][^2]

## What to Watch for in West Virginia

### The Over-15-Psi Permit Has a Long Exception List

The permit section excepts railroad locomotive boilers under federal inspection, portable boilers used for agriculture, boilers on automobiles, boilers of steam fire engines brought in for a temporary emergency, boilers used solely for a private residence, sectional boilers, small portable boilers commonly used in the oil and gas industry about wells and tool houses, and boilers under United States jurisdiction. Read the exception that actually matches the object. A breakdown policy can still cover an excepted boiler.[^1]

### An Insurer Inspection Blocks a Duplicate State Visit

A boiler insured by a company operating in West Virginia, and inspected by that company's boiler inspector, is not subject to Division of Labor inspection during any 12-month period in which the company inspects it. Insurance is not required. If you do not have that inspection, the state visit remains.[^1]

### The Rule Does Not Cover Low-Pressure Heating Boilers

The Division rule that was opened applies to high-pressure steam boilers and forced-flow steam generators. They are inspected internally and externally while not under pressure, and later annual internal inspections use the National Board form named in the rule. Do not use this rule to set an inspection date for a low-pressure heating boiler.[^2]

### A Permit Extension Needs the Insurer and the Inspector

A special inspector is employed or contracted by an insurance company to inspect that company's insured high-pressure steam boilers and forced-flow steam generators, and must hold a Division certificate of competency and meet National Board qualifications. An extension of a permit, not to exceed 60 days, and one additional extension for a maximum temporary extension of 120 days per year, requires a statement from the inspector or special inspector and an authorized party of the insurance company.[^2]

**Reported tax rate:** 4% of premium plus 0.55% surcharge The NAIC's state chart lists a 4% of premium plus 0.55% surcharge charge for surplus-lines coverage for West Virginia (the chart's state entries were reviewed in October 2025). A misdemeanor fine of not less than $100 and not more than $500. Every day of operation without the permit is a separate offense. The permit is annual when the boiler meets the safety requirements.[^1]

### Does the Division's high-pressure boiler rule set the inspection for a low-pressure heating boiler?
