# Equipment Breakdown Insurance in Mississippi

Mississippi rules set annual certificate inspections for power and high-pressure, high-temperature water boilers and biennial inspections for heating boilers and both categories of pressure vessels: those subject to internal corrosion and those not subject to internal corrosion. Only the internal-inspection requirement has a separately conditioned non-corrosiveness exception. Section 45-23-15 text carried forward in a 2026 bill distinguishes whole-chapter exclusions from classes exempt only from §§ 45-23-31 through 45-23-55, but current statutory scope remains unverified because the official current Code text was not readable. The bill died and does not establish current law. These safety rules do not establish equipment-breakdown insurance coverage.[^1][^3][^4][^2]

## What to Watch for in Mississippi

### Get direction before disturbing accident-damaged equipment

Mississippi Rule 1.2.1, expressly labeled “For Information Only,” advises obtaining permission before changing or removing parts after a boiler or pressure-vessel accident: from the insurer if insured, or from the chief or deputy inspector if uninsured, except when removal is needed to save life. For a breakdown, preserve the scene and contact the insurer and state safety branch before teardown when practical; this instruction does not promise claim payment.[^1][^2]

### Match inspection dates to the machine’s category

Mississippi Rule 2.2.1 says the chapter’s inspection rules apply to boilers and pressure vessels used or proposed for use in the state except equipment it describes as exempt under § 45-23-33. That cross-reference is inconsistent: § 45-23-33 is the inspection-requirements section, while the § 45-23-15 text carried forward in the official 2026 introduced HB1049 lists the exemptions. HB1049 died on March 11, 2026, and is not current law. The Secretary of State identifies LexisNexis as the official current-Code publisher, but its link did not yield readable § 45-23-15 text when reopened; the previously cited SOS Act PDF returned 404. Current statutory scope therefore remains unverified.

As reproduced in that 2026 bill, subsection (1) says the chapter does not apply to: (a) boilers and pressure vessels on U.S. government property or under federal control, and pipelines, including compressors and related facilities, subject to federal or other Mississippi-agency inspection; (b) qualifying DOT-compliant compressed-gas transport or storage vessels; (c) air tanks on vehicles operating under other state authorities and used to carry passengers or freight; (d) air tanks on railroad rights-of-way used directly to operate trains; (e) pressure vessels no larger than 5 cubic feet at no more than 250 psig, no larger than 1.5 cubic feet at no more than 600 psig, or 6 inches or less in inside diameter without a pressure limit; (f) vessels operating at no more than 15 psig; (g) vessels for water under pressure with nominal capacity no greater than 120 gallons, including air only as a cushion; (h) vessels under U.S. Atomic Energy Commission licenses or permits; and (i) equipment used in oil or natural-gas production, treating, processing, storage, or transportation only when remote from human habitation or public congregation. Subsection (2) separately lists residential heating boilers in residences or apartment houses with fewer than six family units; domestic-water vessels in those residences or serving rural water systems; vessels covered by Mississippi’s liquefied-compressed-gas inspection law; and tire-service air tanks only if no larger than 15 cubic feet, no more than 250 psig, and used primarily to inflate automobile tires. This subsection exempts those classes only from §§ 45-23-31 through 45-23-55, not from the entire chapter.

For pressure vessels reached by Rules 2.2.1–2.2.5, both those subject to internal corrosion and those not subject to internal corrosion receive biennial certificate inspections. Rule 2.2.5 separately removes only the internal-inspection requirement when contents are known to be noncorrosive to the shell, heads, or fittings by composition, approved corrosion-inhibitor treatment, or corrosion-resistant lining; the vessel must meet Board rules and the Board must approve evidence of non-corrosiveness. Rule 2.2.7 allows the Board to approve longer intervals. Confirm current statutory scope, classification, and due date with the Chief Inspector.[^1][^3]

### Review secondhand and small hot-water equipment before installation

Mississippi’s rules say an owner or user must apply for approval before installing secondhand equipment. They also exclude certain directly fired oil-, gas-, or electric hot-water supply boilers from the rule’s definition only when none of these limits is exceeded: 200,000 Btu per hour, 210°F, or 120 gallons. That definition exclusion does not apply to units in buildings owned by or under the control of the state, a county, municipality, separate school district, or other public entity. This rule-definition carve-out is separate from the statutory categories carried forward in 2026 HB1049, which distinguish chapter-wide exclusions from exemptions limited to §§ 45-23-31 through 45-23-55. HB1049 died and does not establish current statutory scope; the official current Code section was not readable when checked. Confirm any applicable statutory exclusion with the Chief Inspector. Verify classification and approval before counting a used unit as ready for production.[^1][^3]

### Check whether an inspection certificate depends on continued insurance

Mississippi Rule 2.16.1 says a certificate issued after inspection by a special inspector remains valid only while the boiler or pressure vessel continues to be insured by an authorized insurance company. This is a condition on that inspection certificate, not a general mandate to buy equipment-breakdown insurance and not evidence that the policy covers a loss. If a special inspector issued the certificate, coordinate any policy change with the regulator and incoming insurer.[^1]

## Who Regulates Insurance in Mississippi

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 4% premium tax and 0.25% stamping fee on gross premium and policy fees when Mississippi is the insured's home state; MSLA says do not report if Mississippi is not the home state unless 100% of premium is allocated to Mississippi. A separate 3% MWUA fee applies to gross premium and policy fees except residential flood and earthquake. For policies quoted or bound on or after July 1, 2017, Mississippi no longer requires a general diligent search before surplus-lines placement.
