# Equipment Breakdown Insurance in Florida

Florida’s Boiler Safety Act inspection requirements apply only to boilers in public-assembly locations, subject to stated exemptions; the State Fire Marshal also provides a public database of certificates and inspection reports. Do not mistake that narrow regulatory scope for insurance scope: list every critical machine and confirm breakdown, downtime, spoilage and utility-service terms in the policy.[^1][^2][^3]

## What Is Equipment Breakdown?

Equipment-breakdown coverage can help repair covered machinery or building equipment after a mechanical or electrical failure. It fits businesses that depend on equipment to operate; check whether lost income, spoilage and utility failures are included. [Read the national Equipment breakdown guide](/coverage/equipment-breakdown).

## What to Watch for in Florida

### Check whether your location is a public-assembly site

Florida’s statute says Chapter 554 inspection requirements apply only to boilers in public-assembly locations, with an additional stated exemption for boilers from 200,000 through 400,000 Btu/hour subject to code-stamp and data-report conditions. This is a boiler-safety boundary, not a coverage boundary. Ask separately whether the proposed policy covers your boilers and other machinery at every location.[^1][^2][^3]

### Check the specific boiler class and exemption before relying on a certificate search

Florida law sets annual certificate inspections for power boilers and high-pressure, high-temperature water boilers; low-pressure steam or vapor heating boilers and hot-water heating or supply boilers receive biennial certificate inspections. For the hot-water classes, internal inspection is every four years if the boiler’s construction permits. A regulated boiler must be inspected within 30 days after its certificate expires. Use the State Fire Marshal portal to check the unit’s certificate and reports, then confirm its class and location before planning an outage.[^1][^2][^3]

### Ask how failed-boiler reports relate to your claim record

Florida requires a written report after each certificate inspection and for other inspections that find an unsafe boiler, a failure requiring major repair or replacement, or a previously cited code violation. A major-failure report must describe the extent of damage and the cause if known; a violation report must say whether it was corrected, with follow-up inspections no more than six months apart until it is fixed. If the chief boiler inspector finds a boiler unsafe, it must remain shut down until the chief or a deputy clears it at reinspection. Keep the reports with the repair timeline, follow separate policy claim-notice instructions, and ask what interruption, extra-expense or spoilage terms apply.[^1][^2][^3]

## Who Regulates Insurance in Florida

**Florida Office of Insurance Regulation.** The Florida Office of Insurance Regulation licenses and regulates insurance companies and reviews rates and forms. The Department of Financial Services separately licenses insurance agents and handles consumer insurance complaints; its resource page links to both state license searches.[^4][^5][^6]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 4.94% of gross premium plus a 0.03% FSLSO service fee for policies effective July 1, 2026 or later When Florida is the insured’s home state, Florida taxes the entire gross premium at 4.94%; the premium definition includes policy and similar insurance charges. The separate FSLSO service fee is 0.03% for policies effective July 1, 2026 or later. Surplus-lines policies do not receive Florida Insurance Guaranty Association protection.[^7][^8][^9]

## Providers With Documented State Licenses

No provider in Spot’s research documents both a state license record and this coverage line. This does not establish that providers are unlicensed. [Check the regulator’s license lookup](https://myfloridacfo.com/division/ica/resources) and confirm availability with a provider when requesting a quote.

## Questions to Ask Before You Buy in Florida

1. Is the boiler at a Florida public-assembly location, and does a specific statutory exemption apply?
2. Can you verify current certificate and inspection-report status for each regulated boiler in the State Fire Marshal database?
3. What wording, limits and time periods apply to machinery repair, business interruption, extra expense, spoilage and utility-service interruption?

## Equipment Breakdown in Florida: FAQ

### Does Florida’s Boiler Safety Act inspect every commercial boiler?

No. Section 554.108 says its inspection requirements apply only to boilers in public-assembly locations, with specified exemptions. Confirm the exact location and equipment status with the state program.[^1][^3]

### Does a Florida boiler certificate prove that a policy covers breakdown?

No. The certificate records compliance with the state’s boiler-safety rules. Check the policy for covered equipment, causes of breakdown, interruption triggers, spoilage and limits.[^1][^2][^3]
