## What to Watch for in Delaware

### Make the contractor’s report part of the startup handoff

Delaware requires an installation-registration form for a new boiler or pressure vessel; DNREC says the installing contractor submits it to schedule the initial inspection. A Contractor’s Operational Report or CSD-1 report is required before obtaining an operating certificate. Ask for these records and the certificate before relying on a new installation for production.[^1][^2]

### Check the certificate and state inspection record at handoff

Delaware law makes the Boiler Safety Program responsible for inspecting uninsured boilers and pressure vessels and equipment the owner has failed to have inspected. Classify the unit first: § 7403B(b) exempts certain heating and hot-water supply boilers at residences of six or fewer units, and single-unit boilers up to 100,000 Btu/hour, from field inspection only; § 7401B(c) lists other equipment exclusions. At a purchase or facility handoff, match the unit’s nameplate to DNREC’s active/inactive/scrapped list and obtain its inspection and certificate records; a state record does not show that an insurer covers the unit.[^1][^2]

### Keep repair and inspection records with the equipment

Delaware’s Boiler Safety Program addresses fabrication, installation, operation, inspection and repair, and requires the inspector’s report within 30 days. Preserve the equipment identity, operational report, repair documents and inspection certificate; then ask the broker to confirm what repair costs and service-restoration delays the actual policy addresses.[^1][^2]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 3% of gross premium, less return premium, when Delaware is the home state When Delaware is the insured’s home state, its 3% surplus-lines premium tax applies to the entire premium of a multistate policy, less returned premiums and excluding federal and state taxes and examination fees.
