# Oregon EPLI: Five-year windows for specified discrimination claims

Oregon’s current statute sets a five-year BOLI complaint period for specified claims, including discrimination under ORS 659A.030, .082, .112, and .370; other unlawful-practice complaints generally have a one-year deadline. ## What to Watch for in Oregon

### The five-year period is limited to listed statutes

ORS 659A.820(3) provides five years for complaints under §659A.030 and other enumerated sections; subsection (2) keeps a one-year default for other claims. The statute’s 2025 chapter history reflects a current amended text. Ask counsel to classify the actual claim before relying on a deadline.[^1]

### An intake questionnaire is not a filed complaint

BOLI says its questionnaire is the first step; the formal complaint must be written, reviewed, signed, and received by BOLI before it is filed. For a buyer, this affects how an early inquiry or charge should be routed and reported under policy terms.[^2]

### Public employers have additional claim conditions

ORS 659A.875 requires notice under the Oregon Tort Claims Act in civil actions against a public body and sets distinct limitation rules. Ask whether a public entity, public employee, or contractor is involved and have counsel check the applicable notice requirement; a policy does not alter it.[^1]

## Who Regulates Insurance in Oregon

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 2% of Oregon-home-state gross premiums, plus 0.3% on premium or fees for fire marshal For Oregon-home-state risks, the surplus-lines licensee must collect a 2% tax on gross premiums and a 0.3% fire-marshal tax on premium or fees, in addition to the premium.
