# Oklahoma EPLI: A 180-day OCRE charge comes before a lawsuit

Oklahoma law prohibits specified employment discrimination in compensation and other work terms, including classification that limits opportunities. The Attorney General’s Office of Civil Rights Enforcement (OCRE) says an employment complaint must be filed within 180 days of the last alleged act and that its administrative process must be completed before suit.[^1][^2]

## What to Watch for in Oklahoma

### Match the allegation to the state statute

Title 25 §1302 lists race, color, religion, sex, national origin, age, genetic information, and disability for specified hiring, discharge, compensation, and employment terms. It also addresses limiting, segregating, or classifying workers. Ask whether the policy’s definition includes the actual allegations and insured people involved.[^1]

### A short administrative deadline comes first

OCRE states that employment complaints are due within 180 days of the last alleged discriminatory act; a late filing may forfeit legal relief. Preserve agency correspondence and ask the insurer whether the charge or investigation itself is a claim that must be reported.[^2]

### The agency does not act as the employee’s lawyer

OCRE says filing begins an administrative process that must be completed before a lawsuit; it may investigate, conciliate, litigate for the State, or issue a dismissal and notice of right to sue. It explicitly does not represent individual complainants. Ask who coordinates defense counsel and insurer consent if a private suit follows.[^2]

### Surplus-Lines Tax and Stamping Office
