# Ohio EPLI: Four-person scope and a sworn two-year administrative charge

Ohio defines employer as the state, political subdivisions, or a person employing four or more people within the state; domestic service is excluded from the employee definition. Employment charges are due to the Ohio Civil Rights Commission within two years and must be in writing under oath, with specific routes between the commission process and court.[^1][^2]

## What to Watch for in Ohio

### The administrative period is two years

Section 4112.051 requires a written, sworn charge within two years. A timely charge received by mail, email, fax, or otherwise can be signed under oath afterward and relate back. Ask who handles insurer notice when the business receives a charge or request for information.[^2]

### The route affects court filing

A civil damages action generally requires a timely commission charge plus a right-to-sue notice, a specified commission finding/election, or an enumerated federal route; injunctive-only actions have a separate path. A claimant requesting cessation of the commission’s investigation may not refile the charge. Coordinate response strategy with counsel and the insurer.[^2][^3]

### Count Ohio employees and identify domestic work carefully

Ohio’s definition is four or more persons within the state, and its employee definition excludes domestic service. The statute also includes state and political subdivisions without that private-employer count. Do not equate these state thresholds with federal thresholds or assume they establish coverage.[^1]

## Who Regulates Insurance in Ohio

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 5% of gross premium, net of return premiums For Ohio-home-state surplus-lines placements, Ohio sets a 5% tax on gross premiums after returned premiums and requires the surplus-lines broker to collect it when the policy is delivered. A diligent search usually applies; a qualifying exempt commercial purchaser may request nonadmitted placement in writing after disclosure that authorized-market coverage may offer greater protection, and the policy requires a signed notice of no Ohio guaranty-association benefits.[^7][^8][^9]
