# Louisiana employment practices: a 20-employee state threshold and written notice before suit

Louisiana’s Employment Discrimination Law in Chapter 3-A generally covers employers with 20 or more employees in Louisiana on each working day in 20 or more calendar weeks in the current or preceding year, subject to listed exclusions. For a civil action under that chapter, the statute requires written notice at least 30 days before suit and sets a one-year prescriptive period, suspended during administrative review or investigation for no more than six months. Other laws may have separate scope or deadlines.[^1][^3]

### Louisiana’s state-law test uses both size and duration

Section 23:302 looks for 20 or more in-state employees on each working day during 20 or more calendar weeks in the current or preceding year, with statutory exclusions. Do not reduce this to a snapshot headcount.[^1]

### The state chapter identifies specific protected grounds

Section 23:332 lists race, color, religion, sex, national origin, military status, and natural, protective, or cultural hairstyle among prohibited bases. Confirm the specific statute and facts alleged; other laws may add protections.[^2]

### Written notice precedes a Chapter 3-A civil action

Section 23:303 requires a written notice at least 30 days before suit, including specified facts and an effort to resolve in good faith. This procedure is separate from any policy notice obligation.[^3]

### The state civil-action period is one year with a bounded suspension

Section 23:303 provides a one-year prescriptive period, suspended while an EEOC or Louisiana Commission on Human Rights review/investigation is pending, but for no more than six months. Ask counsel to calculate the particular dates.[^3]
