# Employment practices liability in Florida

The Florida Civil Rights Act generally applies to an employer with at least 15 employees for each working day in 20 or more weeks of the current or preceding calendar year. A person generally must file an FCRA complaint within 365 days of the alleged violation. The statute accepts filings through the Florida Commission on Human Relations or qualifying federal/state fair-employment agencies; coordinate the agency’s stamped filing date with the insurer’s separate reporting terms.[^3]

### Include retaliation in the claim discussion

The FCRA separately prohibits retaliation for opposing an unlawful employment practice or participating in an investigation or proceeding. Ask how the policy treats a retaliation claim attached to an earlier discrimination allegation.[^2]

### Review Florida’s listed protected grounds
