## What to Watch for in North Carolina

### Confirm three months of prior coverage

North Carolina continuation applies only after continuous insurance under the group policy, or a predecessor policy with similar benefits, for the three consecutive months immediately before termination. Ask the carrier to confirm the service period before treating a departing employee as eligible.[^1]

### Calendar the election and first payment together

The employee must have at least 60 days after termination or loss of eligibility to elect, and the first contribution is due upon election. Coverage is retroactive to the loss date; tell the employee how to submit the written election and payment so the gap is not mistaken for a denial.[^1]

### Screen for other group coverage

Continuation is unavailable if the person is or could be covered by another insured or uninsured group medical arrangement within 31 days after termination. Have the employee disclose a spouse’s plan or new job coverage before administering the North Carolina option.[^1]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 5% of gross premium, less return premium, plus 0.4% NC Stamping Office fee for ordinary filed placements When North Carolina is the insured’s home state, surplus-lines tax is 5% of gross premium less return premium; ordinary broker-placed filings also carry a 0.4% stamping fee, while risk-purchasing-group and independent-procurement filings follow separate procedures.
