# Kansas digital-asset kiosk insurance questions

Kansas’s 2026 kiosk law imposes a 72-hour hold and other consumer protections for defined transactions at virtual-currency kiosks. A kiosk operator, retail host and wallet custodian should identify which entity controls the transaction and assets during that period; the statutory hold is not insurance.[^1][^2]

**Coverage:** [Digital assets](/coverage/digital-assets) · [Kansas](/coverage/states/kansas)

## What Is Digital Assets?

Digital-asset coverage may address custody, theft and business-liability risks, but a custodian’s policy may protect the custodian rather than you. If you hold or safeguard assets, verify the insured entity, wallets, key-loss protection and valuation. [Read the national Digital assets guide](/coverage/digital-assets).

## Kansas Requirements

| Requirement | Details |
| --- | --- |
| Map the 72-hour transaction hold | For covered kiosk transactions within the statutory period after a customer’s initial transaction, the law requires a 72-hour hold and sets related limits and refund rules. Confirm the exact transaction and customer conditions in the current statute before designing procedures.[^1] |
| Separate operator from kiosk host | Document the licensed operator, physical retail host, transaction service provider and wallet custodian. The enacted law regulates virtual-currency kiosk activity; an unrelated property host should not assume the operator’s duties or insurance.[^1][^2] |

## What to Watch for in Kansas

### Refund rules are conditional

The law distinguishes new and existing customers and includes conditions around refund requests, suspected fraud and reporting. Do not advertise a blanket refund right without checking the operative subsection.[^1]

### Use the enacted effective date

The 2026 act took effect July 1, 2026. Older summaries may predate the new kiosk requirements.[^2][^1]

### A hold is a transaction safeguard

The statutory hold does not establish that theft, fraud, employee misuse, key loss or refund expense is insured. Read the actual policy and identify who is insured while assets are held.[^1][^3][^4]

## Who Regulates Insurance in Kansas

**Kansas Insurance Department.** The Kansas Insurance Department regulates companies selling policies in Kansas for solvency and compliance with state law. Its consumer assistance team reviews written complaints, contacts the appropriate parties and requests corrective action when it finds a Kansas insurance-law violation.[^5][^6][^10][^7]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 3% of gross premiums less returned premiums for surplus-lines insureds whose home state is Kansas; the 3% rate applies beginning with taxable year January 1, 2024 For surplus-lines business whose insured's home state is Kansas, the licensed agent must collect and pay a 3% tax on gross premiums less returned premiums; the 3% rate applies beginning with the taxable year starting January 1, 2024. For an exempt commercial purchaser, the surplus-lines producer need not file the signed diligent-search statement after disclosing that admitted-market insurance may or may not be available and may provide greater protection and oversight, then receiving the purchaser's subsequent written request.[^8][^9]

## Providers With Documented State Licenses

No provider in Spot’s research documents both a state license record and this coverage line. This does not establish that providers are unlicensed. [Check the regulator’s license lookup](https://sbs.naic.org/solar-external-lookup/) and confirm availability with a provider when requesting a quote.

## Questions to Ask Before You Buy in Kansas

1. Who legally operates the kiosk and controls digital assets during the 72-hour hold: your company, a kiosk vendor or a separate custodian?
2. Does your agreement allocate responsibility for customer cancellation, scam reports and the release of held assets?
3. Does the proposed policy identify each operator and wallet, and does it address the specific loss event and valuation method?
4. What procedure prevents staff or vendors from releasing assets before the required hold expires, and who pays if the control fails?

## Digital Assets in Kansas: FAQ

### Does Kansas’s kiosk hold require a digital-asset insurance policy?

The cited act sets kiosk transaction requirements, including a conditional 72-hour hold. It does not itself establish an insurance requirement or a policy’s response.[^1][^2]

### Do the kiosk rules automatically apply to a Kansas company wallet?

The enacted provisions address virtual-currency kiosk operators and kiosk transactions. A business treasury wallet unrelated to kiosk operations raises different questions.[^1]
