# Digital asset business insurance in Colorado

Colorado’s 2025 law creates a defined virtual-currency-kiosk fraud-refund exposure. Effective January 1, 2026, an operator must refund a customer’s first transaction when the statute’s narrow facts are met, including transfer to a wallet or exchange outside the United States and timely notice and evidence. For a kiosk placement, price that operational refund risk and ask about the actual policy response; the law does not insure token-price changes.[^1][^2]

## What to Watch for in Colorado

### The refund is not a general chargeback right

The statute limits mandatory refunds to a customer’s first transaction and the stated foreign-wallet or exchange, notice, timing and evidence conditions. Estimate this exposure from transaction records and ask whether any policy covers the operator’s reimbursement liability, subject to exclusions and limits.[^1]

### Separate kiosk fraud from general custody loss

A kiosk operator may face cash handling, fraud, customer communications, and transfer execution claims. A custodian may instead face continuing control of customer keys and assets. Give the broker the actual operating model and avoid assuming a kiosk-specific law establishes insurance for custodial balances.[^1]

### Market movement is a different loss

The statute addresses specified fraud refunds; it does not require reimbursement merely because a purchased asset falls in value. Review the policy’s digital-asset definition, theft trigger, transfer exclusions, valuation rules and insured entity schedule.[^1]

## Who Regulates Insurance in Colorado

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 3% of net premium When Colorado is the insured’s home state, its surplus-lines tax is 3% of taxable premium. The Colorado Surplus Lines Association says insurer or broker fees charged in connection with the placement are included in the tax base; federal or other-state taxes and examination fees are excluded. For multistate risks, a tax-sharing agreement may allocate premium tax to other states.[^6][^8][^7]
