# Digital asset business insurance in Alaska

In Alaska, check both how virtual-currency activity fits the money-services licensing rules and whether a customer-facing kiosk is operating under the new kiosk provisions. A kiosk operator must hold a money-transmission license and register each Alaska location for prior approval under legislation effective October 1, 2026. For an upcoming placement, schedule each kiosk, wallet flow, and operating entity; that licensing rule does not insure token value or customer balances.[^1][^3]

## What to Watch for in Alaska

### Review the October 1 kiosk change before renewal

The new law takes effect three days after this guide’s September 28, 2026 review date. A kiosk operator should confirm license status, each location’s approval, quarterly reporting, wallet addresses and transaction records before operating under the new provisions; do not apply this kiosk rule to every software or token business.[^3]

### Include third-party control arrangements

Alaska’s licensing materials ask applicants to account for virtual-currency transactions and Alaska customers, while the statute recognizes a virtual-currency control-services vendor. Give the broker the custody diagram, contractual allocation, hot/cold wallet controls, and incident response roles so quotes identify the actual insured service and vendors.[^2][^3]

### A license or financial security is not token insurance

Do not infer that a regulator’s license, bond, or permissible-investment requirement protects a customer against lost keys, a compromised wallet, a failed transfer, or a decline in market price. Check the policy’s insured property, insured entities, custody agreement and valuation terms.[^1]

## Who Regulates Insurance in Alaska

**Alaska Division of Insurance.** The Alaska Division of Insurance regulates insurers and insurance licensees, provides company and licensee searches, and investigates insurance complaints within its authority. Its consumer-services section handles disputes involving claims, cancellations, premium refunds, agents, and insurers.[^4][^5][^6]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 2.7% of gross premium less returns plus 1% filing fee; wet marine: 0.75%, no fee For covered property and casualty surplus-lines risks, Alaska lists a 2.7% tax and a separate 1% filing fee on gross premium less returned premium. Qualifying wet-marine and transportation policies instead carry a 0.75% tax on gross premium and no filing fee; risks of state or local government and certain interstate aircraft are exempt from both tax and fee. A multistate placement is regulated under the insured’s home-state rules, and Alaska says to evaluate each policy’s home state separately.[^8][^7][^9][^10]

**Alaska has a placement-list exception:** If a risk appears on Alaska’s surplus-lines placement list, the Division says the broker does not have to canvass admitted insurers for declinations before placement; the broker must document the applicable list entry.[^7]

**Alaska has limited tax and search exceptions:** The Division says qualifying wet-marine and transportation policies need no diligent search and pay no 1% filing fee. Tax and filing fees also do not apply to state or political-subdivision risks or qualifying interstate aircraft, although other placement requirements remain.[^11]

3. How do crime, cyber, and E&O wording allocate key theft, unauthorized transfers, delayed delivery, and customer refund disputes?
4. Does any policy cover customer property in custody, or only the operator’s own systems and liability?

## Digital Assets in Alaska: FAQ

### When do Alaska’s new virtual-currency kiosk provisions take effect?

SB 249 states that the Act takes effect October 1, 2026. Its new AS 06.55.120 requires a money-transmission license for the defined kiosk activity and department registration and prior approval for a kiosk location in Alaska.[^3]

### Does being licensed make a customer whole if a custodian loses tokens?

No. Licensing governs regulated business activity. A customer’s contractual claim, the custodian’s ability to pay, and any insurance response are separate questions; review the policy and custody terms directly.[^1][^3]
