# Cyber Liability Insurance in Pennsylvania

Since Pennsylvania Act 33 of 2024 took effect 90 days after June 28, 2024, a breach requiring notices to more than 500 people at once triggers nationwide consumer-reporting-agency notice. Certain exposed identity data also triggers access to a credit report and 12 months of credit monitoring; an insurance-data-security exemption applies only to the separate Attorney General filing.[^1][^2]

## What to Watch for in Pennsylvania

### The Credit-Agency Threshold Is Now More Than 500

Act 33 lowered the nationwide consumer-reporting-agency trigger from more than 1,000 to more than 500 persons notified at one time. Ask who tracks the Pennsylvania mailing count and when the agency notices go out; the act says this notice must not be unreasonably delayed.[^1]

### Some Notices Must Offer Twelve Months of Monitoring

If a business provides the required credit-agency notice and reasonably believes a person’s name was accessed with a Social Security number, bank account number, or driver’s license/State ID number, it must cover one independent credit report when the person is not otherwise eligible to get one free and 12 months of credit monitoring, or tell the person no-cost monitoring is available. Ask the response provider how it budgets these benefits; the statute does not establish that an insurance policy pays for them.[^1]

### The Insurance Exception Covers Only the AG Filing

When resident notice must go to more than 500 people, Pennsylvania generally requires a concurrent report to the Attorney General, but entities subject to the state Insurance Data Security Act are exempt from this subsection’s AG report. That exception does not remove the separate credit-agency trigger or conditional credit-report and monitoring duties; ask counsel to map the entity’s specific insurance-law status before relying on it.[^1][^2]

### Pennsylvania Also Lists Account Credentials and Health Data

The amended definition includes health-insurance information and a username or email plus password or security question and answer for online-account access, alongside government identifiers and financial credentials. Ask the incident team to inventory these fields and the data holder before deciding whether Pennsylvania’s notice rules apply.[^1][^2]

## Who Regulates Insurance in Pennsylvania

**Pennsylvania Insurance Department.** The Pennsylvania Insurance Department publishes state tools to check licensed producers, agencies, and insurers, and its Consumer Services Online portal accepts complaints about insurers, agents, brokers, and public adjusters. The department also oversees Pennsylvania insurance business and consumer services.[^3][^4][^5]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 3% of gross premium (2% for eligible surplus-lines risk retention groups) Pennsylvania charges 3% of gross surplus-lines premiums (2% for an eligible surplus-lines risk-retention group); the tax is in addition to premium, is borne by the insured, and is collected by the producer. For multistate risks, the 2025 Revenue instructions say all gross premiums are taxable when Pennsylvania is the home state, while Insurance Company Law §1621(d) says tax is levied only on premium reasonably ascribable to Pennsylvania risk; confirm allocation with your producer or the state. Surplus-lines coverage is excluded from the guaranty association, and qualifying large risks or exempt commercial purchasers may use distinct no-search routes, with the ECP route requiring disclosure and written request.[^6][^7][^8][^9]
