# Cyber Liability Insurance in New York

New York General Business Law §899-aa requires covered businesses to notify affected residents within 30 days after discovering a qualifying breach. A separate DFS rule requires covered entities to report specified cybersecurity events within 72 hours after determination, including events likely to materially harm a material part of normal operations.[^1][^2]

For a breach covered by §899-aa, New York requires notice as expediently as possible and without unreasonable delay, within 30 days after discovery, subject to law-enforcement delay and statutory scope. Coordinate the resident clock with any applicable federal or sector rule.[^1]

### DFS-Regulated Entities Have a Separate 72-Hour Report

A covered entity under 23 NYCRR Part 500 must notify the DFS superintendent within 72 hours after determining an event occurred if it requires reporting to another supervisory body or is reasonably likely to materially harm a material part of operations. Confirm Part 500 status and event criteria before treating this as applicable.[^2]

Part 500 defines covered entities and provides limited exemptions, including thresholds based on New York employees, revenue, and assets for specified requirements. ### Surplus-Lines Tax and Stamping Office
