# Cyber Liability Insurance in Mississippi

Mississippi's general data-breach law, Miss. Code Ann. § 75-24-29, requires any person conducting business in the state who owns, licenses, or maintains personal information of a Mississippi resident to disclose a breach of security to affected individuals — a duty that reaches nearly any commercial buyer with Mississippi customers or employees, not just tech or retail companies. Separately, the Mississippi Insurance Data Security Law (Miss. Code Ann. §§ 83-5-801 to 83-5-825) requires insurers, producers, and adjusters licensed in the state to maintain a written information security program and notify the Insurance Commissioner within three business days of determining a qualifying cybersecurity event, unless a small-licensee exemption applies. A Mississippi-licensed insurance agency buying its own cyber coverage should treat both duties as distinct, not interchangeable.[^1][^2]

## What Is Cyber Liability?

Cyber insurance can help pay covered response costs and claims against your business after a cyber incident. If your business relies on data, software or outside providers, compare response limits, vendor outages and approval rules. [Read the national Cyber liability guide](/coverage/cyber).

## Mississippi Requirements

| Requirement | Details |
| --- | --- |
| General breach-notice duty | Any person conducting business in Mississippi who owns, licenses, or maintains personal information of a Mississippi resident must disclose a breach of security to affected individuals (Miss. Code Ann. § 75-24-29).[^1] |
| Insurance licensee → Commissioner notice deadline | No later than 3 business days after the licensee determines a qualifying cybersecurity event occurred[^1] |
| Domestic insurer annual compliance certification | Written certification of compliance due to the Commissioner by February 15 each year[^1] |
| Small-licensee exemption from the Act's Section 4 program duties | Exempt if the licensee has fewer than 50 employees, less than $5,000,000 in gross annual revenue, less than $10,000,000 in year-end total assets, or is an insurance producer or adjuster[^1] |

## What to Watch for in Mississippi

### The General Notice Duty Is Broader Than It Sounds

Section 75-24-29 covers "any person who conducts business in this state and who, in the ordinary course of the person's business functions, owns, licenses or maintains personal information of any resident of this state" — language broad enough to reach almost any commercial buyer that holds Mississippi customer, employee, or vendor data, not just companies that think of themselves as tech or e-commerce businesses. Ask the broker whether the policy's breach-response coverage is written to respond to this specific statutory duty, not just to a generic "applicable law" reference.[^1]

### Confirm Whether Your Business Is an Insurance "Licensee" Under State Law

The Mississippi Insurance Data Security Law binds MID "licensees" — insurers, producers, and adjusters holding a Mississippi insurance license — not ordinary commercial buyers generally. If your business is itself a Mississippi-licensed insurance agency, MGA, or adjuster buying cyber coverage for its own operations, you carry the Act's information-security-program and Commissioner-notice duties on top of the general consumer-notice law; if you are not a licensee, only the general § 75-24-29 duty applies to you directly.[^1]

### Check the Small-Licensee Exemption Before Assuming the Act Applies

A licensee is exempt from the Act's information-security-program, third-party-service-provider, and Commissioner-notice sections if it has fewer than 50 employees, less than $5 million in gross annual revenue, less than $10 million in year-end total assets, or is an insurance producer or adjuster. Many small Mississippi insurance agencies fall outside these program duties entirely — confirm your actual headcount and revenue against the thresholds rather than assuming the Act applies, since the exemption changes what your incident-response plan and cyber policy actually need to cover.[^1]

### Records Filed With MID Are Shielded From Civil Discovery

Documents and information a licensee furnishes to the Mississippi Insurance Department under the Insurance Data Security Law, or that MID obtains during an investigation or examination under the Act, are confidential and privileged, not subject to subpoena, and not discoverable or admissible in a private civil action. This can affect how a licensee's incident-response team decides what to route through the MID reporting process versus its own counsel-directed investigation; ask the broker or counsel how breach-response vendor engagement should be structured to preserve this protection.[^1]

## Who Regulates Insurance in Mississippi

**Mississippi Insurance Department.** The Mississippi Insurance Department licenses agents and companies, enforces state insurance laws, and investigates insurance complaints. You can use its state lookup or complaint service to check a license or raise an insurance issue.[^3][^4][^5]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 4% premium tax and 0.25% stamping fee on gross premium and policy fees when Mississippi is the insured's home state; MSLA says do not report if Mississippi is not the home state unless 100% of premium is allocated to Mississippi. A separate 3% MWUA fee applies to gross premium and policy fees except residential flood and earthquake. For policies quoted or bound on or after July 1, 2017, Mississippi no longer requires a general diligent search before surplus-lines placement. If Mississippi is the insured's home state, the published charges are 4% premium tax and a 0.25% stamping fee on gross premium and policy fees, plus a separate 3% MWUA fee except for residential flood and earthquake; Mississippi's required policy notice says a nonadmitted insurer is not protected by the Mississippi Insurance Guaranty Association if it becomes insolvent.[^6][^7][^8][^9][^10]

## Providers With Documented State Licenses

These providers publish a national listing for Cyber liability; the state records document licenses for the entities and roles shown below. Some records rely on company-reported information rather than independent regulator verification. A national listing does not confirm that the product is available in Mississippi; [check the regulator’s license lookup](https://www.mid.ms.gov/mississippi-insurance-department/licensing-search/) and confirm state availability for your business when requesting a quote.

- [At-Bay](/insurance-providers/at-bay) — **Entity:** At-Bay Insurance Services LLC; **role:** Insurance producer, Surplus-lines broker; **checked:** 2026-09-28. **Scope:** At-Bay’s license page lists P&C producer and surplus-lines broker license numbers for all 50 states and the District of Columbia. These are company disclosures and do not establish product availability in each jurisdiction.[^11]
- [Coalition](/insurance-providers/coalition) — **Entity:** Coalition Insurance Solutions, Inc.; **role:** Insurance producer, Surplus-lines broker; **checked:** 2026-09-28. **Scope:** Coalition’s license page lists producer and surplus-lines licenses for Coalition Insurance Solutions, Inc. in all 50 states and the District of Columbia. The page separately lists insurers; this record covers the brokerage entity only.[^12]
- [Corgi](/insurance-providers/corgi) — **Entity:** Corgi Insurance Services, Inc.; **role:** Insurance producer; **checked:** 2026-09-28. **Scope:** Corgi’s company producer-license table lists 50 jurisdictions: 49 states and the District of Columbia, including DC license 3003091619. New Mexico does not appear in the table and is not included here; the omission does not establish that Corgi is unlicensed there. The company-reported table has no stated as-of date and does not establish product availability.[^13]
- [Hiscox](/insurance-providers/hiscox) — **Entity:** Hiscox Insurance Company Inc.; **role:** Insurer; **checked:** 2026-09-28. **Scope:** Hiscox’s U.S. company information states that Hiscox Insurance Company Inc. is licensed in all 50 states and the District of Columbia. This is company-reported insurer authority for this entity and does not establish which company issues every Hiscox-branded product.[^14]
- [TechInsurance](/insurance-providers/techinsurance) — **Entity:** Specialty Program Group LLC; **role:** Insurance producer; **checked:** 2026-09-28. **Scope:** TechInsurance’s current licensing page names Specialty Program Group LLC / SPG Insurance Solutions and lists state license numbers, but labels Rhode Island “Individual licenses” rather than identifying a license for the named agency. RI is omitted because this disclosure does not establish agency authority there; this is a search limitation, not an assertion that the company is unlicensed. The remaining state entries are company-reported and are not an insurance product availability map.[^16]
- [Vouch](/insurance-providers/vouch) — **Entity:** Vouch Specialty Insurance Services, LLC; **role:** Insurance producer, Surplus-lines broker; **checked:** 2026-09-28. **Scope:** Vouch’s licenses page, effective January 16, 2025, lists producer licenses in all 50 states and DC. Its separate surplus-lines table includes Idaho number 870820, while a footnote says Georgia and Idaho do not issue agency-level surplus-lines licenses. Because those statements conflict for Idaho, this record keeps Idaho producer-only and does not treat the table number as established agency surplus-lines authority. The page is company-reported and does not establish product availability.[^17]

## Questions to Ask Before You Buy in Mississippi

1. Does the policy's breach-response coverage pay for the notice Mississippi's general breach law (Miss. Code Ann. § 75-24-29) requires us to send to affected Mississippi residents?
2. Is our agency a "licensee" under Mississippi's Insurance Data Security Law, and if so, does the small-licensee exemption apply to us?
3. If we must certify compliance with MID by February 15 each year, does the policy cover the cost of the security assessment behind that certification?
4. Does the policy address costs tied to the three-business-day Commissioner notification deadline if we are a Mississippi-licensed insurer, producer, or adjuster?

## Cyber Liability in Mississippi: FAQ

### Does Mississippi require my business to notify customers after a data breach?

Yes. Miss. Code Ann. § 75-24-29 requires any person conducting business in Mississippi who owns, licenses, or maintains personal information of a Mississippi resident to disclose a breach of security to the affected individuals.[^1]

### How fast must a Mississippi-licensed insurer, producer, or adjuster notify the state Insurance Commissioner after a cybersecurity event?

No later than three business days after the licensee determines that a qualifying cybersecurity event involving nonpublic information has occurred, unless the licensee qualifies for a small-business exemption.[^1]

### Are small insurance agencies exempt from Mississippi's Insurance Data Security Law?

Often, yes. A licensee is exempt from the Act's information-security-program and related duties if it has fewer than 50 employees, less than $5 million in gross annual revenue, less than $10 million in year-end total assets, or is an insurance producer or adjuster.[^1]
