# Cyber Liability Insurance in Maryland

Maryland’s breach law sets a 45-day outside limit for resident notice after discovery or notification, after a prompt investigation finds a likelihood of misuse. Maryland requires the business to notify the Office of the Attorney General before giving required resident notice, with a description, affected-resident count, response steps, and a sample notice. Confirm the AG filing is part of the notice approval workflow and precedes resident distribution.[^1]

### The 45-Day Clock Starts at Discovery or Notice

After a prompt investigation finds likely misuse, the owner or licensee must notify residents as soon as reasonably practicable and no later than 45 days after it discovers or is told about the breach. Ask vendors to preserve the date they notified you, since that can start the clock.[^1]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 3% of gross premiums less returned premiums when Maryland is the insured's home state; excludes risks of Maryland and its political subdivisions When Maryland is the insured's home state, the tax is 3% of gross premiums less returned premiums, except insurance of risks of the State or a political subdivision.
