Kentucky’s private-sector breach rule covers a defined set of unencrypted personal information when unauthorized acquisition causes, or reasonably appears likely to cause, identity theft or fraud against a Kentucky resident. ### The Kentucky Trigger Is Tied to Identity Theft or Fraud

KRS 365.732 defines a covered breach as unauthorized acquisition of unencrypted, unredacted computerized data in a multi-person database that causes or is reasonably believed to cause identity theft or fraud against a Kentucky resident. Ask counsel and your incident team to assess that trigger against the affected data and evidence.[^1]

### Add Credit Agencies Above 1,000 People

When circumstances require notice to more than 1,000 people at one time, Kentucky requires notice without unreasonable delay to nationwide consumer reporting agencies and credit bureaus, including notice timing, distribution, and content. Build the extra coordination into the response plan.[^1][^3]

### A Data Maintainer Must Alert the Owner

A holder that stores data it does not own must notify the owner or licensee as soon as reasonably practicable after discovery if the information was or is reasonably believed to have been acquired without authorization. Put that handoff deadline and the records the owner needs into vendor terms.[^1]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 3% on Kentucky-home-state premiums and other premium consideration; separate 1.8% surcharge on eligible risks located in Kentucky, subject to statutory exceptions; applicable local-government premium tax may also apply When Kentucky is the insured's home state, the state tax is 3% of premium and other consideration treated as premium; local-government premium taxes may also apply.
