# Cyber Liability Insurance in Arkansas

### Keep the Investigation File for Five Years

For a breach determination under § 4-110-105, Arkansas requires a written determination and supporting documentation to be kept for five years. Ask whether your incident team preserves the determination and supporting material in a form your business can retrieve later.[^1][^2]

### The Attorney General Can Request Records

After a written request from the Arkansas Attorney General, you must send the breach determination and supporting documentation within 30 days. Check that your policy’s response support includes retrieving and preparing those records on that timetable.[^1][^2]

### Biometric Data Is Included in the Definition

For a qualifying Arkansas personal-information record and breach, § 4-110-103(7)(E) includes biometric data generated by automatic measurements of biological characteristics, listing fingerprints, faceprints, retinal or iris scans, hand geometry, voiceprint analysis, and DNA. Only the residual category of other unique biological characteristics is limited to those used to uniquely authenticate someone accessing a system or account.
