# Cyber Liability Insurance in Alabama

For an Alabama resident’s qualifying sensitive personally identifying information breach, a covered entity must notify within 45 days after an agent reports the breach or the entity determines both that a breach occurred and that it is reasonably likely to cause substantial harm. For qualifying Alabama-resident sensitive personally identifying information, the 45-day covered-entity clock runs from receipt of a third-party agent’s breach notice or the entity’s determination that a breach occurred and is reasonably likely to cause substantial harm. Ask how your response vendor timestamps both events and escalates a notice to your team.[^2][^1][^3]

### Separate Filing Above 1,000 People

When more than 1,000 individuals must receive notice, Alabama requires a separate filing with the Attorney General. Confirm the incident response service tracks the affected population and includes the state filing when that threshold is crossed.[^4][^6]

### Vendor Notice Is Due Within 10 Days

A third-party agent must notify the covered entity as soon as possible and no later than 10 days after determining that a breach occurred or is reasonably believed to have occurred. If vendors hold your data, ask whether contracts and response services get breach details to you early enough to meet your own deadlines.[^5]

### Alabama Specifies Notice Contents

## Who Regulates Insurance in Alabama

**Alabama Department of Insurance.** The Alabama Department of Insurance oversees insurers and licensed producers, reviews insurance filings, and takes consumer complaints. ### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 6% of taxable surplus-lines premium Alabama’s 6% tax applies to surplus-lines premium when Alabama is the insured’s home state; until the state’s multistate compact clearinghouse is operational, Alabama guidance says 100% of the premium on a multistate policy is taxed here. Separately charged policy fees are taxable. Surplus-lines policies do not receive Alabama guaranty-fund protection if the insurer becomes insolvent.[^10][^11][^13][^12][^16]

**Alabama's diligent-search rule has two exceptions:** A broker generally must make diligent effort before a surplus-lines placement; Alabama guidance says three declinations satisfy it. For an exempt commercial purchaser, 15 U.S.C. § 8205 removes that search only after the broker discloses the admitted-market protection difference and the purchaser then requests placement in writing.[^12][^14][^15]
