# Crime insurance in Nevada: separate employee check fraud from diverted wires

A Nevada crime review should account for employees or contractors who process checks, take money or property, or control electronic payments. Nevada's current 2025 UCC text includes certain retained independent contractors in a narrow fraudulent-endorsement rule and provides a separate funds-transfer security procedure framework. These commercial-law rules allocate rights in bank transactions; they do not determine whether your policy covers an employee loss or a wire redirected by impersonation.[^1][^2]

## What to Watch for in Nevada

### Map contractor check authority, not just access

NRS 104.3405 includes an independent contractor and the contractor's employee retained by the employer within “employee” for the section. Its responsibility definition covers signing, acting on received instruments, preparing checks, supplying payee information, or controlling disposition; mere access to instruments being stored, transported, or mailed is excluded. Tell the broker which tasks are delegated and ask how the policy defines employee, covered property, and dishonest acts.[^1]

### Read the full funds-transfer security procedure

NRS 104A.4201 defines a security procedure as a procedure agreed between the customer and receiving bank to verify orders or detect errors, and it says signature comparison or requiring use of a known email, IP address, or telephone number alone does not qualify. Section 104A.4202 also looks at commercial reasonableness, the customer's stated wishes, normal payment pattern, and alternatives offered. Preserve the bank's records and ask the broker separately about fraudulent-instruction and social-engineering wording.[^2]

### Compare first-party grants and respond fast

Ask for limits and sublimits for employee dishonesty, checks, computer fraud, funds transfer, social engineering, and money away from the premises or in transit. If a vendor or executive impersonation redirects payment, the FBI advises contacting your financial institution immediately and reporting BEC to IC3. Preserve the original communications and notify the insurer under the policy's own terms.[^3]

## Who Regulates Insurance in Nevada

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** Same tax rate as admitted coverage of the same kind; an approved filing fee may also apply When Nevada is the insured’s home state, Nevada taxes surplus-lines coverage at the rate imposed on similar admitted coverage and adds any approved filing fee; the rate therefore depends on the line and applicable fee approval.
