# Crime insurance in Missouri: align check review with employee-dishonesty protection

For a Missouri business that issues checks or handles customer payments, identify who signs, processes, or directs instruments—including retained contractors—and who checks statements for unauthorized signatures or alterations. Missouri law treats certain retained contractors as employees for a narrow fraudulent-endorsement rule and requires customers to examine statements with reasonable promptness. These bank-facing rules do not decide policy coverage; ask separately about employee dishonesty, forged instruments, funds transfer, and notice terms.[^1][^2]

### Describe who controls each check step

Missouri Revised Statutes §400.3-405 includes an independent contractor and the contractor's employee retained by the employer within “employee” for the section. Responsibility includes signing, processing received instruments, preparing instruments, supplying payee information, or controlling disposition; mere access to checks in storage, transport, or mail is excluded. Explain those duties to the broker, but do not treat this bank-allocation rule as proof the policy covers a contractor's dishonest act.[^1]

### Assign prompt review of paid-item statements

Section 400.4-406 requires reasonable promptness in examining statements or items for unauthorized signatures or alterations and prompt notice to the bank when the business should reasonably have discovered a payment. It also addresses repeated items by the same wrongdoer after a reasonable examination period of no more than 30 days, and a one-year outside preclusion rule. Keep a review log and ask the insurer for the policy's independent discovery and claim-reporting deadlines.[^2]

### Keep wire and social-engineering coverage in the comparison

Check fraud is only one exposure. Ask which insuring agreement, limit, and retention would be considered for employee dishonesty, computer fraud, unauthorized funds transfers, social engineering, and money away from the premises or in transit. If a vendor or executive impersonation redirects a wire, the FBI recommends immediate bank contact and an IC3 report; preserve the original message and approval history.[^3]

No. Section 400.3-405 is a rule about fraudulent endorsements and rights among people who pay or take instruments. The policy's definitions and insuring agreements determine whether an act and loss are covered.[^1]

### Does §400.4-406 give the business one year to report an insurance claim?
