# Crime insurance in Minnesota: check bank authentication and preserve transfer evidence

List how employees access cash, checks, payroll, and online payment accounts, then compare those exposures with the policy's grants and limits. Minnesota's current funds-transfer statute says signature comparison or sending an order from a known email address, IP address, or phone number alone is not a “security procedure”; it also describes a separate bank-notice rule for unauthorized orders. Neither rule establishes crime-policy coverage or substitutes for policy reporting deadlines.[^1][^2]

## What to Watch for in Minnesota

### Ask what authentication the bank agreement actually requires

Minnesota Statutes §336.4A-201 defines a security procedure as one established by agreement between customer and receiving bank. It expressly says that signature comparison or requiring an order from a known email address, IP address, or telephone number is not by itself such a procedure. Obtain the bank's complete security-procedure agreement and ask the broker how the policy treats unauthorized transfers and social engineering; the statute does not resolve insurance coverage.[^1]

### Do not treat bank notice timing as an insurance deadline

Under §336.4A-204, failure to use ordinary care to identify an unauthorized payment order and notify the bank within a reasonable time capped at 90 days after bank notice affects interest on a refund; the bank is not entitled to recover from the customer solely for that missed notification. This is a customer-bank rule, not a 90-day crime-claim window. Ask for policy discovery, notice, and proof-of-loss dates and report a suspected loss promptly.[^2]

### Preserve the message and payment trail

A business-email-compromise message can impersonate a vendor or executive and redirect a wire. If money is sent, contact your financial institution immediately and ask it to contact the receiving institution; report the scam to IC3. Keep original email headers, invoices, callback records, approval logs, and bank communications for the bank and insurer.[^3]

## Who Regulates Insurance in Minnesota

**Minnesota Department of Commerce.** The Minnesota Department of Commerce regulates insurance companies and producers, reviews rates and forms, and investigates complaints. You can use its state lookup or complaint service to check a license or raise an insurance issue.[^4][^5][^6]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 3% of taxable gross premiums less return premiums, plus a 0.04% stamping fee on taxable premium when Minnesota is the insured's home state When Minnesota is the insured's home state, 3% tax applies to taxable gross premiums less return premiums; the separate 0.04% stamping fee on taxable premium is paid by you to the broker. Minnesota requires a policy warning that insolvency loss payment by a nonadmitted insurer is not guaranteed. A diligent search generally applies unless a Minnesota-licensed producer unaffiliated with the surplus-lines broker refers the risk, which the statute deems unavailable from a licensed insurer; an exempt commercial purchaser also has a separate written-request route after the required admitted-market disclosure.[^7][^10][^8][^9][^11]

## Crime in Minnesota: FAQ

### Does a bank's use of a known email address alone count as a security procedure in Minnesota?

Section 336.4A-201 says that requiring an order from a known email address, IP address, or telephone number is not by itself a security procedure. Review the entire agreement and its additional verification steps.[^1]

### Does the 90-day bank notice provision give 90 days to notify the crime insurer?

No. Section 336.4A-204 addresses notice to a receiving bank and interest on a refund. The insurance policy sets its own reporting terms.[^2]
