# Maine Crime Insurance Guide

Maine’s check rules call for prompt review of bank statements and give a business a limited period to report unauthorized signatures or alterations to its bank. A notable difference from many states’ current UCC text is that Maine Title 11 Article 3, including § 3-405, is repealed; do not assume that section supplies Maine’s rule for an employee’s forged endorsement. Map who handles checks, assign a statement reviewer, and ask a broker to show how the policy treats employee dishonesty, forged checks, and wires sent after social engineering.[^1][^2][^3][^4]

## What to Watch for in Maine

### Do not import a repealed check rule

Maine Title 11 Article 3, Commercial Paper, marks § 3-405 and the article’s other sections as repealed. Avoid assuming another state’s current employee-endorsement rule applies in Maine. For your own policy review, list who can prepare checks, endorse incoming items, control payee details, and reconcile accounts, then ask the broker how those people are treated by the form.[^2]

### Review paid items and report promptly

Maine § 4-406 requires a customer to examine available statements or items with reasonable promptness and promptly notify the bank of unauthorized signatures or alterations. For later items by the same wrongdoer, the bank may have a defense after a reasonable review period of no more than 30 days; the statute also sets an outside one-year period. These are bank-account rules, not insurer notice deadlines.[^1]

### Keep access to check images and approval records

Under Maine § 4-406, a bank must return or make paid items available, or provide identifying statement details; when the items are not returned, the person retaining them must keep them or be able to furnish legible copies for seven years. Ask your bank how to retrieve images and preserve your own approvals and reconciliations. Check the policy for its separate proof and notice requirements.[^1]

## Who Regulates Insurance in Maine

**Maine Bureau of Insurance.** The Maine Bureau of Insurance licenses producers and companies, enforces Maine insurance laws, and investigates property and casualty complaints including commercial coverage complaints. ### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 3% of gross direct premium when Maine is the insured's home state Maine charges 3% of gross direct premium when it is the insured's home state; your broker handles the tax and may include it with the premium. Surplus-lines policies are outside Maine guaranty-association protection. Maine generally requires a diligent search, with an exempt-commercial-purchaser exception requiring broker disclosure and the purchaser's written request.[^8][^9][^10]

### Can a Maine business rely on Title 11 § 3-405 for employee check fraud?

No. The Maine Legislature’s Title 11 Article 3 page marks § 3-405 as repealed. Ask a Maine attorney about rights around a specific instrument and ask the broker to identify applicable policy wording.[^2]

### Does Maine’s one-year bank period also apply to an insurance claim?

No. Section 4-406 concerns claims against the bank over unauthorized signatures or alterations. Use the policy’s own reporting and proof-of-loss instructions.[^1]
