# Louisiana Crime Insurance Guide

Louisiana businesses should map check handling and wire approval as separate loss paths. Louisiana Revised Statutes Title 10 includes retained independent contractors in a specific rule on fraudulent check endorsements, while its funds-transfer law separately addresses when a bank may treat a payment order as the customer’s under an agreed security procedure. Those statutes allocate rights around payment transactions; they do not establish what a crime policy covers. Ask the broker to identify check, employee-dishonesty, funds-transfer, and social-engineering wording separately.[^1][^2]

## What to Watch for in Louisiana

### List who processes or controls checks

Louisiana R.S. 10:3-405 includes a retained independent contractor and its employee in the section’s definition of employee. Responsibility can include endorsing, processing, preparing, choosing payees for, or controlling negotiable instruments; mere access to stored or mailed forms is not enough. Ask whether the quote’s employee definition includes your outside bookkeeper or payment service.[^1]

### Review the procedure agreed with your bank

Under R.S. 10:4A-202, a payment order may be effective as the customer’s order if a bank and customer agreed on a commercially reasonable security procedure and the bank accepted the order in good faith while following that procedure and recorded instructions. Review who can send wires, transaction limits, and approved verification steps. This bank rule does not answer whether the policy covers a wire induced by deception.[^2][^3]

### Have an immediate response path for spoofed instructions

The FBI advises businesses to contact their financial institution immediately after discovering a business-email compromise and ask it to contact the receiving institution; it also recommends reporting through IC3. Preserve the message, wire record, and approval trail, and follow the insurer’s separate notice instructions.[^4]

## Who Regulates Insurance in Louisiana

**Louisiana Department of Insurance.** The Louisiana Department of Insurance licenses producers and insurers, reviews insurance filings, and investigates complaints about insurance companies and agents. You can use its state lookup or complaint service to check a license or raise an insurance issue.[^5][^6][^7]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 4.85% of gross premium plus a 0.175% SLIP+ transaction fee for policies effective on or after July 1, 2026 For Louisiana-home-state policies effective on or after July 1, 2026, the state charges 4.85% of gross premium plus a 0.175% SLIP+ transaction fee, which your broker may add to your bill. Louisiana's required policy disclosure says these policies are not covered by the Louisiana Insurance Guaranty Association; state placement and filing rules still apply.[^8][^9]

## Crime in Louisiana: FAQ

### Does Louisiana’s check-endorsement statute require insurance to cover a contractor?

No. R.S. 10:3-405 includes a retained independent contractor in a commercial-law rule about certain negotiable-instrument losses. It does not determine the insurance policy’s definition of employee or coverage.[^1]

### Does a bank’s payment-order rule decide a crime insurance claim?

No. R.S. 10:4A-202 addresses rights and duties around payment orders and agreed verification procedures. The policy’s insuring agreement, exclusions, limits, and conditions govern the separate insurance question.[^2][^3]
