# Hawaii Crime Insurance Guide

For a Hawaii business, a forged check handled by an employee and a wire sent after a spoofed email are different payment events. Hawaii’s Uniform Commercial Code has separate rules for employee-related check indorsements and for funds transfers, including agreed bank security procedures; those rules allocate rights around payment transactions, not insurance benefits. Map both workflows and ask your broker to identify employee-dishonesty, forgery, funds-transfer, and social-engineering terms separately.[^1][^2]

## What to Watch for in Hawaii

### Include contractors who can process checks

Hawaii Revised Statutes § 490:3-405 includes a retained independent contractor in its employee definition for a specified fraudulent-indorsement rule. Its definition of responsibility covers more than signing: it includes processing received checks, preparing issued instruments, and controlling their disposition. Ask whether policy definitions and limits reach the people who handle your checks.[^1]

### Review your bank’s wire security procedure

Hawaii Article 4A addresses agreed security procedures and whether payment orders are authorized or verified. Before a crime renewal, review the procedure your business agreed to with its bank and ask whether the policy distinguishes an unauthorized transfer from an employee-authorized payment made after social engineering. The UCC rule does not establish insurance coverage.[^1]

### Treat a suspected wire scam as time-sensitive

The FBI recommends contacting your financial institution immediately after discovering business-email compromise and asking it to contact the receiving institution; file a report with IC3 as well. Keep bank contact and policy notice steps in your incident plan.[^2][^3]

## Who Regulates Insurance in Hawaii

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 4.68% of premium when Hawaiʻi is the home state Hawaiʻi applies a 4.68% tax when it is the insured’s home state. Surplus-lines coverage is placed with an unauthorized insurer, so do not assume the Hawaiʻi Insurance Guaranty Association protects the policy; confirm the insurer’s status and policy terms with your broker.[^7][^8]

## Crime in Hawaii: FAQ

### Does a crime policy automatically treat check fraud and a spoofed wire as the same loss?

No. Hawaii law addresses negotiable instruments and funds transfers in separate parts of its Uniform Commercial Code, and an insurance form’s definitions and insuring agreements control the policy question. Ask the broker to show the relevant clauses for each event.[^1]

### What should we do immediately after a spoofed wire?

Call your financial institution immediately, request that it contact the receiving institution, and report the incident to IC3. Follow the policy’s own notice instructions too.[^2][^3]
