# Arizona Crime Insurance Guide

Arizona requires certain insurance administrators that handle insurer or insured money to maintain a state-held deposit, eligible securities, or a surety bond; that safeguard addresses legally owed benefits and fraud or dishonesty. A licensed money transmitter has a separate surety-bond requirement. Identify which entity and funds each requirement covers before you compare either with first-party employee-theft or payment-fraud coverage.[^1][^2]

## What Is Crime?

Crime insurance can help reimburse specified business losses from theft and fraud, including employee theft and forgery. Compare those protections separately and ask whether a payment sent after an impersonation scam is covered. [Read the national Crime guide](/coverage/crime).

## Arizona Requirements

| Insurance administrators handling funds | An administrator must maintain a deposit for insureds and insurers whose money it handles. The security may be cash, eligible securities, or a surety bond; the amount is generally 10% of funds handled unless the director approves less, and a bond cannot be below $5,000. The statute says this security is payable if the administrator fails to pay benefits it legally owes and protects insureds and insurers against fraud or dishonesty.[^1] |

## What to Watch for in Arizona

### An administrator’s statutory security has a defined purpose

If your Arizona business is an insurance administrator handling funds for insurers or insureds, check whether its state security is cash, securities, or a surety bond and whose benefit it serves. The statute addresses benefits legally owed by the administrator and fraud or dishonesty, but it does not set the terms of your separate crime policy; ask how employee theft, unauthorized transfers, and funds held for others are handled in that policy.[^1]

### A money transmitter bond secures transmission obligations

If you hold an Arizona money-transmission license, the required surety bond is tied to the licensee’s money-transmission liability and is payable under that regulatory arrangement. Do not count its face amount as employee-theft or impersonation-payment protection; ask the broker to map the bond and crime policy to their different obligations and claim triggers.[^2]

### Payment-agent status depends on the transaction

Arizona’s money-transmission article has a narrow payee-agent exemption: a written agreement must authorize collection for the payee, the payee must hold the agent out as accepting payment, the payor’s debt must be extinguished when the agent receives funds, and the payor cannot face loss if the agent fails to remit. If your business processes customer payments, ask counsel or the regulator whether the actual arrangement meets every condition before relying on an exemption.[^3]

## Who Regulates Insurance in Arizona

**Arizona Department of Insurance and Financial Institutions.** Arizona DIFI regulates insurance companies and insurance professionals, including producers and surplus-lines brokers. ### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 3% of gross premium and taxable policy fees, less returns; stamping fee rate not verified When Arizona is the insured’s home state, the tax is 3% of gross premium and taxable policy fees, less returned premium; the statute excludes stamping fees from that tax base. For a multistate risk, Arizona’s share is allocated by exposure under the statute. Arizona's surplus-lines policy notice says these policies do not receive guaranty-fund protection. **Arizona has an exempt-commercial-purchaser search exception:** A surplus-lines broker generally must make diligent effort to place an Arizona risk in the admitted market. For an exempt commercial purchaser, federal law removes that search only after the broker discloses the admitted-market protection difference and the purchaser then asks in writing for nonadmitted coverage.[^8][^10]
