# Alabama Crime Insurance Guide

Alabama’s fidelity rules turn on your role: an insurer-appointed managing general agent may need a state-compliant fidelity bond or commercial crime policy, while covered employees are not automatically included in a PEO’s fidelity bond. Match the quoted policy to the entity handling the money and the people it covers.[^1][^2]

## Alabama Requirements

| Insurer-appointed managing general agents | For covered appointments, Rule 482-1-106-.04(1)(a) calls for an insurer-protection fidelity bond of at least $100,000 with no deductible, unless expressly waived by the Commissioner. Rule .04(2) sets the annual adjusted limit for a fidelity bond or commercial crime policy at the greater of $100,000 or 25% of the premium the MGA wrote for the appointing insurer in Alabama during the prior calendar year; adjust by April 1.[^1] |

## What to Watch for in Alabama

### An MGA policy protects the appointing insurer

The filing rule applies only to appointments meeting Rule 482-1-106-.03(1). For a foreign authorized insurer, the MGA must either (1) produce and underwrite gross premium at least 5% of the insurer’s policyholder surplus in a quarter or year and handle claims above $10,000 per claim or negotiate reinsurance, or (2) produce and underwrite Alabama risks and handle claims above $10,000 per claim, claims above 5% of the insurer’s surplus in aggregate per year, or negotiate reinsurance. For an Alabama-domiciled insurer, the MGA must produce and underwrite gross premium over 5% of policyholder surplus in a quarter or year and handle claims or negotiate reinsurance. The rule excludes insurer employees, a U.S. branch manager of an alien insurer, a qualifying common-control underwriting manager, and a reciprocal-exchange attorney-in-fact. For a covered appointment, verify any express waiver and the annual limit: greater of $100,000 or 25% of prior-calendar-year Alabama premium the MGA wrote for the appointing insurer. This instrument protects that insurer; it is not a limit recommendation for your own crime policy.[^1]

### PEO workers need express fidelity-bond inclusion

If you use a professional employer organization (PEO), Alabama law says covered workers do not become the PEO’s employees for fidelity-bond purposes solely because of the PEO arrangement. Ask the PEO and broker to point to the specific references that include your covered workers in the agreement and applicable insurance contract or bond.[^2]

### A self-insurance fund has a separate administrator bond

An Alabama workers’ compensation group self-insurers fund must provide a fidelity bond on its administrator to protect the fund’s assets against misappropriation or misuse. If you participate in or administer such a fund, compare the filed administrator bond with any separate crime policy and check whose assets and conduct each protects.[^3]

**Alabama Department of Insurance.** The Alabama Department of Insurance oversees insurers and licensed producers, reviews insurance filings, and takes consumer complaints. ### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 6% of taxable surplus-lines premium Alabama’s 6% tax applies to surplus-lines premium when Alabama is the insured’s home state; until the state’s multistate compact clearinghouse is operational, Alabama guidance says 100% of the premium on a multistate policy is taxed here. Separately charged policy fees are taxable. Surplus-lines policies do not receive Alabama guaranty-fund protection if the insurer becomes insolvent.[^7][^8][^10][^9][^13]

**Alabama's diligent-search rule has two exceptions:** A broker generally must make diligent effort before a surplus-lines placement; Alabama guidance says three declinations satisfy it. For an exempt commercial purchaser, 15 U.S.C. § 8205 removes that search only after the broker discloses the admitted-market protection difference and the purchaser then requests placement in writing.[^9][^11][^12]

2. If a PEO handles payroll or other funds, which agreement and policy language expressly includes your covered workers for fidelity losses?
3. If you are part of a workers’ compensation self-insurance fund, who is named on the administrator bond and which fund assets does it protect?

## Crime in Alabama: FAQ

### Does the Alabama MGA fidelity amount set my own crime-policy limit?

No. The filing requirement protects the appointing insurer, and its annual formula uses premium the MGA wrote for that insurer in Alabama. It does not set the MGA’s own crime-policy limit; compare that policy with your own employees, funds, controls, and likely loss scenarios.[^1]

### Does a PEO arrangement automatically include covered workers in the PEO’s fidelity bond?

No. Alabama law says PEO status alone does not make covered employees employees of the PEO for fidelity-bond purposes; the applicable agreement, insurance contract, or bond must include them by specific reference.[^2]
