# Louisiana looks to the policy terms when classifying insolvency claims

Louisiana’s guaranty-association statute says the kind and coverage of insurance are determined from the policy’s terms, not its name or marketing label. It separately excludes financial-guaranty and investment-risk protection, as well as bonds. For a contract-frustration proposal, ask how its actual trigger and indemnity promise are classified; the statute does not answer whether the policy covers a particular contract event.[^1][^2]

## What to Watch for in Louisiana

### The policy text matters more than its product name

Louisiana directs that insurance kind and coverage for the association act are determined solely by the policy provisions, regardless of the name, label, marketing designation, or other characterization. Ask the broker to show how the policy’s trigger and payment promise fit the identified insurance class.[^1]

### Financial-guaranty and bond exclusions are distinct

Louisiana excludes financial-guaranty and investment-risk insurance and separately excludes fidelity or surety bonds and other bonding obligations. A financial-guaranty exclusion is not a rule that every contract-frustration policy is financial guaranty; a bond exclusion is not a rule that every performance-related policy is surety.[^1]

### Association eligibility is separate from policy coverage

Louisiana’s statute limits covered claims to claims under policies issued by member insurers and requires a Louisiana residence or business principal-place-of-business connection, or qualifying property located in the state. These rules concern a possible association claim after insolvency, not whether the insurer must pay under the policy.[^2]

**Reported tax rate:** 4.85% of gross premium plus a 0.175% SLIP+ transaction fee for policies effective on or after July 1, 2026 For Louisiana-home-state policies effective on or after July 1, 2026, the state charges 4.85% of gross premium plus a 0.175% SLIP+ transaction fee, which your broker may add to your bill. Louisiana's required policy disclosure says these policies are not covered by the Louisiana Insurance Guaranty Association; state placement and filing rules still apply.[^6][^7]
