# Ask Iowa insurers how they classify the promise and its trigger

Iowa law separates insurance against specified financial risks from bonding for performance of a contract. Neither label determines the class of a contract-frustration policy. Ask the insurer to explain whether the form covers your own loss after a defined event or guarantees another party’s debt or performance, and what classification applies.[^2][^1]

## What to Watch for in Iowa

### Iowa defines financial guaranty by the loss it protects against

Iowa’s rule describes financial-guaranty insurance as protection against loss from a financial obligation, including default on debt or monetary obligations and changes in interest rates, currency values, or asset values. That definition is about the actual protected risk; it does not establish that a policy for a frustrated commercial contract is financial guaranty.[^2]

### A contract-performance bond is a distinct question

The same rule excludes from its financial-guaranty definition contract bonds that guarantee execution of contracts other than debt or monetary obligations. Iowa’s guaranty-association statute also excludes surety and bonding obligations. If a proposal promises to make a counterparty perform, ask whether it is a surety bond, who the obligee is, and which event triggers payment.[^2][^1]

### Match the insured event to the policy wording

A contract may fail for reasons unrelated to a financial default, and an insolvency-fund classification rule does not decide whether those reasons trigger policy benefits. Ask the broker to map the event you fear to the policy’s covered-loss definition, exclusions, waiting periods, and proof requirements.[^1]

## Who Regulates Insurance in Iowa

**Iowa Insurance Division.** The Iowa Insurance Division licenses insurance producers and maintains separate lists for licensed insurers and surplus-lines insurer categories. Its filing page routes most rate, rule and form filings through SERFF and identifies filings requiring prior approval; eligible surplus-lines insurers are not required to file or seek approval of their rates or forms.[^3][^9][^8][^4][^5]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 0.925% of surplus-lines premiums when Iowa is the insured's home state, for 2026 When Iowa is the insured's home state, the 2026 premium tax is 0.925%, and the surplus-lines producer shall collect and pay it to the state in addition to gross premium. Placement generally requires an eligible surplus-lines insurer and a diligent search showing the full amount or type is unavailable from an admitted insurer; an exempt commercial purchaser may bypass that search only after the producer discloses that admitted insurance may be available and may offer greater protection and oversight, then the purchaser subsequently requests surplus-lines placement in writing.[^6][^7]
