# Verify the Idaho policy class before relying on guaranty-fund protection

Idaho’s Insurance Guaranty Association Act excludes financial-guaranty and investment-risk insurance, surety obligations, and retroactive policies covering known claims from the association’s scope. If the insurer fails, a covered claim also needs an Idaho residence or in-state permanently located property connection.[^1][^2]

## What to Watch for in Idaho

### Financial-guaranty and surety exclusions are separate

Idaho lists financial guaranty or investment-risk protection separately from fidelity or surety bonds. Ask whether the insurer treats the proposed coverage as an indemnity policy, a bond, or another insurance class, and why the policy’s trigger fits that class. This statute does not decide where contract-frustration coverage belongs.[^1]

### A policy written after a known claim may be outside the association act

The act excludes insurance written retroactively for known losses when a claim has already been made and the insurer knows of it when the policy is bound. If a contract problem has already become a claim before purchase, ask the insurer how the proposed effective date and prior-knowledge wording treat it.[^1]

### Idaho association eligibility uses the insured event’s location or residence

The covered-claim definition generally requires the claimant or insured to be an Idaho resident at the event, using a business’s principal place of business for an entity, or the claim must involve first-party damage to property permanently located in Idaho. This test concerns association protection after insurer insolvency, not whether the policy itself covers a loss.[^2]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 1.5% of premium when Idaho is the home state for property and casualty coverage Idaho’s surplus-lines tax is 1.5%. For property-and-casualty insurance other than workers’ compensation, if Idaho is the insured’s home state the full premium is taxed regardless of where covered risks are located; other lines follow the statutory allocation rule. ### Does a contract dispute already underway automatically make a later policy a known-loss policy?
