## What Is Contract Frustration?

Contract frustration may fit your business when an international contract is exposed to political disruption or government action. If your main risk is a customer who cannot pay, compare trade-credit coverage instead. [Read the national Contract frustration guide](/coverage/contract-frustration).

## What to Watch for in Alabama

### Use State Export Support for Market Entry

The Alabama International Trade Center offers export assistance to Alabama companies. Use its market-entry support to map the destination country and buyer before you insure the contract. Ask the state program which current activities qualify and whether you need approval before spending. Treat any award as help with the export project, not as payment for a disrupted contract.[^1][^3]

### Check the Placement Route

Alabama requires a licensed surplus-lines broker to place this type of nonadmitted policy with an eligible carrier; its administrative rule also sets financial-integrity conditions for alien insurers. Ask for the carrier’s eligibility basis before comparing limits.[^2]

### Schedule the Contract and Trigger

For an Alabama company planning a first shipment, ask whether the named policy trigger occurs before or after the foreign customer receives the goods; the answer changes which invoices and performance costs you should schedule.[^1][^2]

## Who Regulates Insurance in Alabama

**Alabama Department of Insurance.** The Alabama Department of Insurance oversees insurers and licensed producers, reviews insurance filings, and takes consumer complaints. Its online services page links directly to Alabama company and agent searches, licensing resources, and complaint filing.[^4][^5][^6]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 6% of taxable surplus-lines premium Alabama’s 6% tax applies to surplus-lines premium when Alabama is the insured’s home state; until the state’s multistate compact clearinghouse is operational, Alabama guidance says 100% of the premium on a multistate policy is taxed here. Separately charged policy fees are taxable. Surplus-lines policies do not receive Alabama guaranty-fund protection if the insurer becomes insolvent.[^7][^8][^10][^9][^13]

**Alabama's diligent-search rule has two exceptions:** A broker generally must make diligent effort before a surplus-lines placement; Alabama guidance says three declinations satisfy it. For an exempt commercial purchaser, 15 U.S.C. § 8205 removes that search only after the broker discloses the admitted-market protection difference and the purchaser then requests placement in writing.[^9][^11][^12]

## Providers With Documented State Licenses

No provider in Spot’s research documents both a state license record and this coverage line. This does not establish that providers are unlicensed. [Check the regulator’s license lookup](https://aldoi.gov/OnlineServices.aspx) and confirm availability with a provider when requesting a quote.

## Questions to Ask Before You Buy in Alabama

1. Which Alabama export office or program applies to my target market, and must it approve the expense before I incur it?
2. Will you place this contract-frustration coverage with an admitted insurer or through Alabama surplus lines, and what filing, disclosure, tax, or fee applies?
3. Which named contracts, government actions, payment interruptions, or blocked transfers trigger the policy, and when does the waiting period start?
4. Does the policy cover pre-shipment costs, an unpaid post-shipment invoice, or both, and how does it calculate the covered loss?
