# Commercial Property Insurance in West Virginia

West Virginia Code §33-17-9 applies to insurers providing fire insurance on real property: for a total loss by fire or otherwise, as stated in the policy, liability is the whole amount insured; for partial loss by fire or otherwise, it is the loss amount up to that limit. The statute excepts insurance covering the same interest from two or more insurers. “Or otherwise” does not make a peril insured; check the policy’s covered causes before coordinating layers.[^1]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 4% of premium plus 0.55% surcharge The NAIC's state chart lists a 4% of premium plus 0.55% surcharge charge for surplus-lines coverage for West Virginia (the chart's state entries were reviewed in October 2025).
