# Commercial Property Insurance in New York

New York's residual-market NYPIUA commercial policy separates mandatory Group I causes—fire, lightning, explosion, vandalism, and sprinkler leakage—from optional Group II wind, hail, smoke, aircraft or vehicle, and riot coverage. New York repealed Insurance Law §3403 effective October 17, 2025, and NYPIUA says the anti-arson form is no longer required for new business, renewals, or endorsements effective on or after that date; use the current application and declarations to confirm selected perils and any updated submission items.[^1][^3][^2]

## What to Watch for in New York

### Confirm Optional Wind and Hail

NYPIUA's commercial page lists windstorm or hail in optional Group II, while Group I is mandatory and has a different peril list. If the residual-market option is quoted, confirm whether Group II was selected and compare its limit and deductible with any separate building coverage.[^1]

### Ask Whether Business Income Is Available

NYDFS says NYPIUA may provide business-income insurance to manufacturing and non-manufacturing operations, while describing the pool as an option for buyers unable to obtain this property coverage from individual insurers. Ask whether your business class and requested income limit are available on the actual quote.[^2]

### Use the Post-Repeal Application

Chapter 439 of the 2025 laws repealed Insurance Law §3403, effective immediately; NYPIUA states it stopped requiring its Anti-Arson Form for new business, renewal, and endorsement effective October 17, 2025 or later. Ask the producer to use the current submission checklist and disregard any legacy form instruction that conflicts with the effective-date change.[^3][^4]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 3.6% of gross premium, less returned premium; ELANY stamping fee is 0.15% through 2026 and 0.17% for policies incepting on/after Jan. 1, 2027 When New York is the insured’s home state, excess-line tax is 3.6% of gross premium less returned premium.
