# Commercial Property Insurance in New Jersey

New Jersey's FAIR Plan is available to owners unable to obtain standard coverage and insures most commercial buildings and business property, but its basic property coverage excludes theft and personal liability; optional theft can be attached. For a commercial policy that covers loss of use and business interruption, insurers must provide the state's one-page summary with the application or renewal, giving you a consistent starting point for checking triggers and exclusions.[^1][^2]

**Coverage:** [Commercial property](/coverage/commercial-property) · [New Jersey](/coverage/states/new-jersey)

## What Is Commercial Property?

Commercial property may fit your business if you own a building or rely on equipment and stock. Compare replacement-cost terms, deductibles and any coinsurance condition, and check lost-income protection separately. [Read the national Commercial property guide](/coverage/commercial-property).

## What to Watch for in New Jersey

### Check Theft Separately on FAIR Coverage

NJDOBI says the FAIR Plan's basic property coverage does not include theft or personal liability, although optional theft is available as an attachment. If a FAIR quote is offered, ask whether theft is included on the actual proposal and obtain a separate liability quote for the premises exposure.[^1]

### Use the FAIR Plan After Market Shopping

NJDOBI describes the FAIR Plan as an option after a property owner cannot obtain coverage through a standard company and advises using it only when no other source is available. Compare the full proposal with any standard-market quote before accepting the plan's basic property terms.[^1]

### Request the State Business-Interruption Summary

For a policy covering commercial-property loss of use and business interruption, N.J.S.A. 17:29AA-34 requires the insurer to provide NJDOBI's one-page summary with the application or renewal. Read its trigger and exclusion explanations beside the quote, then compare them with the actual policy wording and endorsements.[^2][^3]

### Compare Filed Terms Across Quotes

NJDOBI's property-and-casualty office reviews commercial rates, rules, and forms in New Jersey. That regulatory process does not determine which terms a carrier includes in your particular quote, so ask for the complete form and compare deductibles, exclusions, and business-income conditions line by line.[^4]

## Who Regulates Insurance in New Jersey

**New Jersey Department of Banking and Insurance.** New Jersey DOBI licenses insurers and producers, reviews insurance products and rates, monitors insurer solvency and responds to insurance complaints. The Property and Casualty unit regulates commercial and personal property and casualty rates, rules and forms.[^5][^6][^7][^8]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 5% of gross premium, less return premium New Jersey’s Department of Banking and Insurance states a 5% surplus-lines tax for policies effective on or after July 1, 2009; its FAQ also describes direct-procurement tax filing for premium allocated to New Jersey. A New Jersey surplus-lines producer generally must make a diligent effort to place the risk with authorized insurers, subject to the exportable-list and other statutory exceptions. New Jersey’s separate surplus-lines guaranty fund has narrow coverage; ordinary commercial surplus-lines claims are generally outside guaranty protection.[^9][^10][^11]

## Providers With Documented State Licenses

These providers publish a national listing for Commercial property; the state records document licenses for the entities and roles shown below. Some records rely on company-reported information rather than independent regulator verification. A national listing does not confirm that the product is available in New Jersey; [check the regulator’s license lookup](https://www.nj.gov/dobi/inslic.htm) and confirm state availability for your business when requesting a quote.

- [ERGO NEXT Insurance](/insurance-providers/next-insurance) — **Entity:** Next First Insurance Agency, Inc.; **role:** Insurance producer; **checked:** 2026-09-28. **Scope:** ERGO NEXT’s current license table lists Next First Insurance Agency, Inc. in 50 jurisdictions, including Washington, DC; New York is excluded because its table rows name Next Insurance Services and AP Intego, not Next First. The table is company-reported; it does not establish product availability or provide state-regulator verification for each entry.[^16]
- [Risklytics](/insurance-providers/risklytics) — **Entity:** Risklytics, Inc.; **role:** Insurance producer; **checked:** 2026-09-28. **Scope:** Risklytics’ licensing page lists its Massachusetts resident agency license plus state license records in Arizona, Colorado, Illinois, Indiana, New Jersey, Ohio, Texas and Washington; it identifies the NPN record date as September 10, 2026. This list is company-published and not a product availability map.[^17]
- [TechInsurance](/insurance-providers/techinsurance) — **Entity:** Specialty Program Group LLC; **role:** Insurance producer; **checked:** 2026-09-28. **Scope:** TechInsurance’s current licensing page names Specialty Program Group LLC / SPG Insurance Solutions and lists state license numbers, but labels Rhode Island “Individual licenses” rather than identifying a license for the named agency. RI is omitted because this disclosure does not establish agency authority there; this is a search limitation, not an assertion that the company is unlicensed. The remaining state entries are company-reported and are not an insurance product availability map.[^18]
- [Vouch](/insurance-providers/vouch) — **Entity:** Vouch Specialty Insurance Services, LLC; **role:** Insurance producer, Surplus-lines broker; **checked:** 2026-09-28. **Scope:** Vouch’s licenses page, effective January 16, 2025, lists producer licenses in all 50 states and DC. Its separate surplus-lines table includes Idaho number 870820, while a footnote says Georgia and Idaho do not issue agency-level surplus-lines licenses. Because those statements conflict for Idaho, this record keeps Idaho producer-only and does not treat the table number as established agency surplus-lines authority. The page is company-reported and does not establish product availability.[^19]

## Questions to Ask Before You Buy in New Jersey

1. Does the FAIR Plan proposal include optional theft coverage, and where is that shown in the form or endorsement?
2. Which other standard-market carriers were approached before the FAIR Plan was recommended?
3. Can you provide the New Jersey business-interruption summary with this application or renewal and identify the matching policy provisions?
4. Does the quote cover business income only after direct physical loss, and what waiting period, restoration period, and exclusions apply?

## Commercial Property in New Jersey: FAQ

### Does the New Jersey FAIR Plan insure commercial property?

Yes. NJDOBI says it insures most commercial buildings and business property when standard coverage cannot be obtained; its basic coverage excludes theft and personal liability, though optional theft is available.[^1]

### Must a New Jersey insurer provide a business-interruption summary?

Yes, for an application or renewal of a policy that covers loss of use and occupancy of commercial property and business interruption in New Jersey. The summary does not replace the policy terms.[^2][^3]
