# Commercial Property Insurance in New Hampshire

New Hampshire law treats the stated amount on a building totally destroyed by fire or lightning as the value of the insured's interest, subject to a fraud exception—but that rule does not apply to blanket limits covering multiple buildings or buildings and personal property. ## What to Watch for in New Hampshire

### Confirm the Building Has a Specified Amount

RSA 407:11 applies its stated-value rule to a building totally destroyed by fire or lightning when criminal fault by the insured or assignee is absent; partial losses remain capped at the sum insured. Ask whether the declarations assign a specified amount to each building and check the valuation wording for other kinds of loss.[^1]

### Check the Blanket-Limit Exception

The statute expressly excludes from its total-loss rule a blanket amount covering two or more buildings or buildings together with personal property, and it does not prohibit coinsurance or agreed-amount clauses. If you insure several locations or a building-and-contents schedule, ask how the limit and coinsurance clause apply after a large fire.[^1]

### Identify the Applicable Fire Form

RSA 407:2 generally prescribes a standard fire form but lists motor-vehicle, marine, inland-marine, and reinsurance exceptions; RSA 407:2-a allows qualifying combination policies to use another form if the fire coverage and other listed conditions meet the statute. Ask the insurer which rule applies to your commercial package and request the complete form and endorsements.[^2]

### Do Not Budget a Commercial Grant from the Home Program

Effective August 31, 2026, RSA 407-E creates a grant program for homeowners mitigating residential real property and says funding is subject to available appropriations; it does not create an entitlement. A business should not assume that commercial buildings qualify and should check any other funding program separately.[^3]

### Surplus-Lines Tax and Stamping Office
