# Cargo insurance for South Dakota shipments

South Dakota's motor-carrier handbook treats proof of vehicle liability insurance as a credential and requires the card to identify the registrant and vehicle (or say “Fleet Insured”). That card does not describe cargo protection. Ask for shipment-specific cargo terms, and distinguish them from any federal interstate cargo filing.[^1][^3]

## What Is Cargo And Transit?

## South Dakota Requirements

| Vehicle insurance evidence | South Dakota operators must carry an Evidence of Motor Vehicle Liability Insurance card from an insurer authorized in the state; it must show the registrant and VIN or state “Fleet Insured.”[^1] |
| Interstate cargo filing category | FMCSA's chart lists no federal cargo filing amount for nonhazardous for-hire property carriers, but lists $5,000 for household-goods carriers with GVWR of at least 10,001 pounds. Those are federal financial-responsibility filings, not a limit recommendation for the value of your goods.[^3] |

## What to Watch for in South Dakota

### A vehicle insurance card identifies auto liability, not your load

The state handbook calls this evidence motor-vehicle liability insurance and specifies the vehicle or fleet identifier. Request cargo policy evidence and ask whether you are insured as owner of the goods or the carrier is insured for contractual/legal cargo liability.[^1]

### Do not carry an interstate filing assumption into an intrastate haul

FMCSA's chart describes filings for federal operating-authority categories. Confirm whether the shipment is interstate and whether it is household goods before using that chart; it does not establish South Dakota intrastate cargo insurance or the coverage in a private policy.[^2][^3]

### A $0 federal cargo filing does not mean goods are insured

For nonhazardous interstate property carriers, FMCSA lists $0 as the cargo filing requirement. That is a filing rule, not a finding that a carrier bought no cargo policy or that your goods are covered; request policy limits, valuation, covered goods, and any exclusions.[^3]

## Who Regulates Insurance in South Dakota

**South Dakota Division of Insurance.** The South Dakota Division of Insurance regulates insurance companies and producers and publishes tools to verify producer and company licenses. ### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 2.5% of premium; commercial property adds 0.175% fire tax, inland marine 0.075%; no stamping fee South Dakota adds 2.5% surplus-lines tax; its current chart lists an additional fire tax of 0.175% for commercial property and 0.075% for commercial inland marine, none for commercial liability, and no stamping fee.
