# Cargo Insurance in New Mexico

For household-goods carriers subject to New Mexico Department of Transportation rules, the required cargo-liability filing is $50,000 per shipper for loss or damage to that shipper’s cargo. A policy deductible is generally capped at $5,000 unless the Department approves a higher deductible with added security. The carrier’s bill of lading must also record the chosen released, declared, or replacement value; none of these filing amounts alone establishes your shipment’s full replacement protection.[^1][^2]

## What Is Cargo And Transit?

Cargo coverage fits a shipper protecting goods it owns or a carrier responsible for another party’s goods. The quote needs to match who bears the loss, the shipment route and storage stops. [Read the national Cargo and transit guide](/coverage/cargo-transit).

## New Mexico Requirements

| Requirement | Details |
| --- | --- |
| Household-goods cargo-liability filing | $50,000 per shipper for loss or damage to the shipper’s cargo under 18.3.3.10(B)(2) NMAC, effective July 1, 2024; the rule also sets a $5,000 deductible ceiling unless a higher deductible is approved with a surety bond or qualifying self-insured amount.[^1] |

## What to Watch for in New Mexico

### Read “Per Shipper” Alongside Your Shipment Value

The $50,000 rule is a carrier filing minimum per shipper, not a statement that every shipment is covered up to its full value. Compare your highest load value with the proposed policy limit and ask how one event affecting more than one shipment is handled.[^1]

### Check the Deductible, Not Just the Limit

New Mexico generally caps a carrier’s policy deductible at $5,000. A higher deductible requires Department approval plus a bond or qualifying self-insurance for the difference, so request the deductible and the filing evidence for the actual carrier.[^1]

### Put the Valuation Choice on the Bill of Lading

The current household-goods rule requires a bill of lading before transport and requires the shipper to accept released, declared, or replacement value in writing. Each option uses a different settlement basis; check the election and shipment-wide maximum before loading.[^2]

## Who Regulates Insurance in New Mexico

**New Mexico Office of Superintendent of Insurance.** New Mexico OSI licenses insurance producers and agencies, oversees insurers and reviews insurance forms and rates. Its Consumer Assistance Bureau accepts insurance complaints, including complaints involving commercial and business insurance.[^3][^4][^5][^6]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 3.003% of taxable surplus-lines premium (verify allocation and current return instructions) New Mexico’s surplus-lines tax is listed as 3.003% of taxable premium in the state’s surplus-lines tax-return instructions; confirm current allocation and filing treatment with the New Mexico Taxation and Revenue Department because its current program page distinguishes broker-placed surplus lines from independently procured insurance. Surplus-lines coverage is issued by an unauthorized insurer and is outside ordinary state guaranty-association protection; do not treat the separate self-procured tax as the surplus-lines broker tax.[^7][^8][^9][^10]

## Providers With Documented State Licenses

No provider in Spot’s research documents both a state license record and this coverage line. This does not establish that providers are unlicensed. [Check the regulator’s license lookup](https://www.osi.state.nm.us/en/license-status-verification/) and confirm availability with a provider when requesting a quote.

## Questions to Ask Before You Buy in New Mexico

1. What cargo limit applies per shipper, and what is the maximum amount payable for all goods in one event?
2. What deductible applies to this carrier’s filed cargo policy, and is any amount above $5,000 backed by approved security?
3. Which released, declared, or replacement-value option and shipment maximum will the bill of lading record?

## Cargo And Transit in New Mexico: FAQ

### What cargo-liability minimum applies to a New Mexico household-goods carrier?

18.3.3.10(B)(2) NMAC requires $50,000 in cargo-liability insurance per shipper for loss or damage to that shipper’s cargo. This operating minimum is not a valuation of your goods or a promise that every loss is covered.[^1]

### Does New Mexico require a shipper to accept released value?

No. The rule requires the bill of lading to record the shipper’s acceptance of a chosen liability option; it lists released, declared, and replacement value, each with a different basis for settling loss or damage.[^2]
