Delaware allows a bill of lading or transportation agreement to cap carrier liability at a stated value only when rates depend on value and the consignor gets and is advised of a chance to declare a higher value. Under 6 Del. C. § 7-309, a carrier's contractual value cap depends on value-based rates plus a real opportunity and notice to declare more; it does not apply to conversion to the carrier's own use. Compare the bill of lading's declared value with the shipment and ask what remedy remains if the goods are lost.[^1]

Delaware permits reasonable terms about when and how to present claims and begin shipment actions in the bill of lading or transportation agreement. Calendar those dates separately from any notice requirements in your own policy.[^1]

**Reported tax rate:** 3% of gross premium, less return premium, when Delaware is the home state When Delaware is the insured’s home state, its 3% surplus-lines premium tax applies to the entire premium of a multistate policy, less returned premiums and excluding federal and state taxes and examination fees.
