# South Dakota Business Owner’s Policy Guide

South Dakota’s Division of Insurance says P&C policy forms must be filed and approved, subject to exemptions for exempt commercial policyholders, and its consumer guidance describes cancellation and nonrenewal notices for P&C contracts. Those rules govern filings and continuity; they do not add BOP benefits. Compare the issued policy’s property limits, liability terms and business-income trigger, then check the separate workers’ compensation obligations for your workforce.[^1][^2]

### Compare the package form and its schedules

The Division says P&C policy forms must be filed and approved, while exempt commercial policyholders are subject to statutory filing exemptions. Filing status is not a promise of particular benefits: review the issued declarations, property valuation and causes of loss, liability limits and business-income trigger against the operations and assets you need to protect.[^1]

### Understand cancellation and renewal notice rules

South Dakota’s Division says a P&C contract generally may be canceled midterm only for statutory grounds, with 20 days’ prior notice, and lists a 60-day nonrenewal notice rule subject to exceptions. Ask the insurer how these rules apply to this policy and keep renewal dates and replacement coverage aligned; these notice rules do not expand coverage.[^1]

### Resolve workers’ compensation outside the BOP

South Dakota DLR says its workers’ compensation law covers employers subject to listed exceptions, including agricultural labor and certain domestic employment. Determine which categories of your workforce are covered and arrange the required protection separately from a BOP.[^2]

## Who Regulates Insurance in South Dakota

**South Dakota Division of Insurance.** The South Dakota Division of Insurance regulates insurance companies and producers and publishes tools to verify producer and company licenses. ### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 2.5% of premium; commercial property adds 0.175% fire tax, inland marine 0.075%; no stamping fee South Dakota adds 2.5% surplus-lines tax; its current chart lists an additional fire tax of 0.175% for commercial property and 0.075% for commercial inland marine, none for commercial liability, and no stamping fee. ### Is a contractor’s certificate alone enough to establish independent-contractor status for workers’ compensation premium?

A 2014 Division of Insurance bulletin says payroll review and noting whether a certificate exists alone are not an adequate process for charging contractor premium. Ask the current workers’ compensation carrier what evidence it uses to determine classification.[^3]
