# North Dakota Business Owners Policy: Budget for Flood Outside Mapped Areas

North Dakota DOI says locations outside mapped floodplains can still experience flash flooding and that commercial NFIP coverage can reach $500,000 each for building and contents in participating communities. Ask whether these caps leave a replacement-cost gap, and compare the BOP's flood exclusion, contents limit and business-income terms with separate flood options.[^1][^2]

**Coverage:** [Business owner’s policy](/coverage/business-owners-policy) · [North Dakota](/coverage/states/north-dakota)

## What Is Business Owner’S Policy?

A BOP may suit an eligible small business that wants property, liability and lost-income protection together. If you also need auto, workers’ compensation or professional liability, plan for separate coverage. [Read the national Business owner’s policy guide](/coverage/business-owners-policy).

## What to Watch for in North Dakota

### Do not use the map as the only flood test

The Department says North Dakota experience shows locations outside floodplains can be susceptible to flooding, particularly flash floods. Evaluate drainage, prior water entry and site operations in addition to the mapped zone, then ask for a separate flood quote.[^1]

### Compare NFIP caps with business values

The Department lists a $500,000 maximum for commercial building coverage and a separate $500,000 maximum for contents under NFIP. Compare both figures with the structure and business-property schedule; do not assume the BOP fills any difference or covers flood damage.[^1]

### Separate hail protection from flood protection

North Dakota DOI describes wind and hail as named causes that may appear in property forms and says standard flood coverage is single-peril flood, not wind or hail. Ask the insurer to identify the BOP's wind and hail terms and quote flood separately rather than expecting either policy to cover both perils.[^2][^1]

## Who Regulates Insurance in North Dakota

**North Dakota Insurance Department.** The North Dakota Insurance Department regulates insurers and producers, provides licensing and company searches, and investigates insurance complaints to assess compliance with state law and policy terms.[^3][^4][^5]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 1.75% of gross premium, assessments and policy fees, less return premium, when North Dakota is home state When North Dakota is the insured’s home state, the 1.75% tax applies to the entire gross premium, assessments, membership and subscriber fees, and policy or service fees on multistate policies, less return premium. North Dakota permits independent procurement only under separate statutory conditions; the policyholder should confirm whether a licensed broker placement or independent procurement applies. Nonadmitted insurers generally do not participate in state guaranty funds.[^6][^7][^8]

## Providers With Documented State Licenses

These providers publish a national listing for Business owner’s policy; the state records document licenses for the entities and roles shown below. Some records rely on company-reported information rather than independent regulator verification. A national listing does not confirm that the product is available in North Dakota; [check the regulator’s license lookup](https://www.insurance.nd.gov/producers/print-license) and confirm state availability for your business when requesting a quote.

- [Corgi](/insurance-providers/corgi) — **Entity:** Corgi Insurance Services, Inc.; **role:** Insurance producer; **checked:** 2026-09-28. **Scope:** Corgi’s company producer-license table lists 50 jurisdictions: 49 states and the District of Columbia, including DC license 3003091619. New Mexico does not appear in the table and is not included here; the omission does not establish that Corgi is unlicensed there. The company-reported table has no stated as-of date and does not establish product availability.[^11]
- [ERGO NEXT Insurance](/insurance-providers/next-insurance) — **Entity:** Next First Insurance Agency, Inc.; **role:** Insurance producer; **checked:** 2026-09-28. **Scope:** ERGO NEXT’s current license table lists Next First Insurance Agency, Inc. in 50 jurisdictions, including Washington, DC; New York is excluded because its table rows name Next Insurance Services and AP Intego, not Next First. The table is company-reported; it does not establish product availability or provide state-regulator verification for each entry.[^13]
- [Hiscox](/insurance-providers/hiscox) — **Entity:** Hiscox Insurance Company Inc.; **role:** Insurer; **checked:** 2026-09-28. **Scope:** Hiscox’s U.S. company information states that Hiscox Insurance Company Inc. is licensed in all 50 states and the District of Columbia. This is company-reported insurer authority for this entity and does not establish which company issues every Hiscox-branded product.[^12]
- [TechInsurance](/insurance-providers/techinsurance) — **Entity:** Specialty Program Group LLC; **role:** Insurance producer; **checked:** 2026-09-28. **Scope:** TechInsurance’s current licensing page names Specialty Program Group LLC / SPG Insurance Solutions and lists state license numbers, but labels Rhode Island “Individual licenses” rather than identifying a license for the named agency. RI is omitted because this disclosure does not establish agency authority there; this is a search limitation, not an assertion that the company is unlicensed. The remaining state entries are company-reported and are not an insurance product availability map.[^14]

## Questions to Ask Before You Buy in North Dakota

1. Does your location's flood assessment include flash flooding and drainage beyond the FEMA mapped floodplain?
2. Do the proposed flood building and contents limits match your replacement estimate and inventory, given the NFIP's separate $500,000 commercial caps?
3. Which form covers wind and hail, and what separate deductible or exclusion applies compared with flood?

## Business Owner’S Policy in North Dakota: FAQ

### Can a North Dakota business need flood insurance outside a mapped floodplain?

The North Dakota Insurance Department says locations outside the floodplain can still be susceptible to flooding, especially flash flooding. NFIP flood policies are available for commercial structures in participating communities; check the address and terms.[^1]

### What are the North Dakota page's NFIP commercial limits?

The Department lists up to $500,000 for a commercial building and up to $500,000 for contents. Ask whether those amounts fit your exposure and compare any separate excess or private flood option.[^1]
