# Missouri Business Owner’s Policy Guide

Missouri law treats a total covered-peril loss to insured real property differently from partial damage and lists important exceptions, including builder’s risk, multi-building blanket coverage and replacement-cost coverage. Identify whether the BOP location is individually scheduled or part of a blanket and compare building valuation, contents and income provisions in the issued forms.[^1][^2]

## What Is Business Owner’S Policy?

## What to Watch for in Missouri

### Missouri’s total-fire-loss rule has material exceptions

Section 379.140 applies to a covered total loss of real property, not partial loss; unscheduled personal property; detached/appurtenant structures; builder’s risk or mortgage-insurance policies; multiple buildings insured on a blanket basis; contributing fraud or criminal activity; an unconsented risk increase in the preceding 60 days that caused the loss; replacement-cost coverage (which remains governed by the policy); or a loss covered by multiple policies. A separate subsection sets initial-assigned-value treatment for a blanket-insured commercial building.[^1]

### Blanket limits need a building-by-building review

The statute has separate treatment for multi-building blanket coverage, using the value assigned to each building at policy inception and remaining terms. Ask for the schedule, each building’s assigned value and how limits are shared after a loss.[^1]

### Partial fire-loss settlement follows a different rule

For the specified standard fire policy, §379.150 allows settlement at actual cash value or repair/rebuild/replace with like kind and quality within a reasonable time, with notice within 30 days after proof of loss. Read the issued valuation and settlement language for damage short of a total loss.[^2][^3]

### The property rule does not set package income or liability benefits

These statutes concern fire-property valuation and settlement. They do not set a BOP’s liability limits, covered business-interruption events or restoration period; those depend on the package forms.[^1][^2]

## Who Regulates Insurance in Missouri

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 5% of premium; Missouri taxes the entire gross premium when Missouri is the home state When Missouri is the insured’s home state, the state applies its 5% surplus-lines tax to the entire gross premium of a multistate policy; the regulator’s FAQ says the tax includes applicable fees. Eligible nonadmitted insurers do not participate in the Missouri Guaranty Fund, and Missouri generally requires the full amount or kind of coverage to be unavailable from admitted insurers before placement; an exempt commercial purchaser search exception has separate disclosure and written-request conditions.[^8][^9][^10][^11]
