# Pennsylvania builders risk: permit jurisdiction and occupancy milestones

Pennsylvania requires NPDES coverage for qualifying construction disturbance of one acre or more, subject to listed activity exceptions and permit eligibility. Separately, the Uniform Construction Code is enforced by most municipalities locally, while state jurisdiction applies in opt-out locations and for specific facilities. The gaps that cost owners money are materials in storage or transit, the existing building in a renovation, and coverage ending when you occupy early. ## What to Watch for in Pennsylvania

### Check disturbance and project type

DEP requires NPDES permit coverage for construction activities with earth disturbance of at least one acre, excluding agricultural plowing or tilling, animal heavy-use areas, timber harvesting and road maintenance. Eligible applicants may use PAG-01 or PAG-02; ineligible work may need an individual permit. Ask who owns or operates the project and whether phased disturbance is included.[^1]

### The municipality can determine who handles building-code enforcement

Pennsylvania says more than 90% of municipalities administer and enforce the UCC locally. In an opt-out municipality, the Department handles commercial enforcement; other stated state scopes also apply. Identify the municipality and actual code official before building the permit and inspection timeline into the insurance submission.[^2]

### Coordinate the certificate-of-occupancy milestone

The state permit guidance says a UCC certificate of occupancy must issue before a building is used; it also notes an emergency repair/equipment-replacement exception when an application is submitted within three business days. Do not assume the certificate itself sets policy termination. Give the broker the expected first-use and phased-opening dates.[^3]

## Who Regulates Insurance in Pennsylvania

**Pennsylvania Insurance Department.** The Pennsylvania Insurance Department publishes state tools to check licensed producers, agencies, and insurers, and its Consumer Services Online portal accepts complaints about insurers, agents, brokers, and public adjusters. ### Surplus-Lines Tax and Stamping Office

For multistate risks, the 2025 Revenue instructions say all gross premiums are taxable when Pennsylvania is the home state, while Insurance Company Law §1621(d) says tax is levied only on premium reasonably ascribable to Pennsylvania risk; confirm allocation with your producer or the state.
