# Oregon builders risk: phased construction and waterside work

Oregon’s current 1200-C permit can cover phased developments that reach one acre and explicitly includes staging, stockpiling, demolition and vertical construction. Separate removal-fill rules apply to many activities in wetlands and waters, with different thresholds and exceptions. Give the broker the whole project plan, waterside work, materials locations and the exact phase insured.[^1][^2][^3]

## What Is Builders Risk?

Builders risk protects the project you are building, including materials meant for it, against physical loss until construction ends. The gaps that cost owners money are materials in storage or transit, the existing building in a renovation, and coverage ending when you occupy early. ## What to Watch for in Oregon

### Count site work across phases

Oregon’s 1200-C permit applies to disturbance of one acre or more and to smaller disturbance within a common plan that reaches one acre; it also includes a small site that is a required component of a one-acre final project. The current permit became effective December 15, 2025 and expires December 14, 2030.[^1]

### Staging and vertical work are within the permit scope

DEQ states that once a project meets the coverage criteria, staging, stockpiling, demolition and vertical construction are also regulated. Include these phases and any change in start or completion dates in the broker’s project description; the permit does not set policy coverage dates.[^2]

### Material near wetlands or waters

Oregon generally requires a removal-fill permit for moving more than 50 cubic yards in wetlands or waters, and for any amount in designated Essential Salmonid Habitat, State Scenic Waterways and mitigation sites. Maintenance or reconstruction and some small-volume work have exceptions. Confirm resource boundaries and permit status before describing stockpiles or temporary works.[^3]

## Who Regulates Insurance in Oregon

**Oregon Division of Financial Regulation.** DFR handles complaints about most insurance lines and provides Oregon license checks for agents, agencies, and insurers. You can use its consumer complaint form if an insurer or agent is not following Oregon law or rules.[^4][^5][^6]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 2% of Oregon-home-state gross premiums, plus 0.3% on premium or fees for fire marshal For Oregon-home-state risks, the surplus-lines licensee must collect a 2% tax on gross premiums and a 0.3% fire-marshal tax on premium or fees, in addition to the premium. ### Does a small Oregon phase stay outside 1200-C if it disturbs less than one acre?

Not necessarily. DEQ includes smaller disturbance within a common plan reaching one acre and work that is a necessary component of a final one-acre project.[^1]

### Does every Oregon wetland or water project need a removal-fill permit?

No. The general threshold is more than 50 cubic yards in most wetlands or waters; named areas can require a permit for any amount, and specified work has exceptions. Confirm the site’s resource boundary and activity with DSL.[^3]
