# Ohio builders risk: identify the site operator and permit boundary

Ohio’s NPDES construction rules include smaller phases within a qualifying common plan, and the permit application identifies the owner or operator, coordinates and ground-disturbance boundary. EPA issues NPDES permits on tribal lands in Ohio; Ohio EPA issues permits elsewhere. Give the broker the exact parcel, work boundary and operator rather than assuming the developer and contractor roles are interchangeable.[^1][^2][^3]

## What to Watch for in Ohio

### Count the full common plan

Ohio’s NPDES rules include construction below one acre when it is part of a larger common plan of at least one acre; the small-construction category is limited to one to under five acres unless separately designated. Routine maintenance that preserves line, grade, hydraulic capacity or original purpose is excluded from that definition.[^1]

### Name the actual operator

For construction stormwater coverage, Ohio’s NOI rule asks for the owner or operator’s identity, project coordinates and a map outlining the ground-disturbance boundary. The operational-control role may differ from the property owner. Tell the broker who owns the project, directs daily site work and owns stored materials.[^2]

### Check permit authority by parcel

EPA says it issues NPDES permits for Ohio tribal lands, while Ohio EPA issues other NPDES permits. If a project crosses or abuts tribal jurisdiction, identify each project parcel and ask which operator and property locations the proposed policy names.[^3]

## Who Regulates Insurance in Ohio

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 5% of gross premium, net of return premiums For Ohio-home-state surplus-lines placements, Ohio sets a 5% tax on gross premiums after returned premiums and requires the surplus-lines broker to collect it when the policy is delivered. A diligent search usually applies; a qualifying exempt commercial purchaser may request nonadmitted placement in writing after disclosure that authorized-market coverage may offer greater protection, and the policy requires a signed notice of no Ohio guaranty-association benefits.[^7][^8][^9]
