# North Carolina builders risk: coastal permits and responsible parties

North Carolina’s permit path depends on both site and project: coastal CAMA rules put single-family homes in the minor-permit category and reserve major permits for specified project sizes or projects needing other permits. For qualifying disturbance, the stormwater permittee must match the financially responsible party. Give the broker the county, permit applicant, site-work phase and material locations.[^2][^1]

## What Is Builders Risk?

Builders risk protects the project you are building, including materials meant for it, against physical loss until construction ends. The gaps that cost owners money are materials in storage or transit, the existing building in a renovation, and coverage ending when you occupy early. [Read the national Builders risk guide](/coverage/builders-risk).

## What to Watch for in North Carolina

### Coastal site and project size

In the 20 coastal counties, CAMA permits are divided into major, general, minor and some exempt work. Single-family homes require minor permits; major permits are needed for projects over 20 acres, construction over 60,000 square feet, or projects requiring other state or federal permits. The class affects the permit timeline, not insurance coverage.[^2]

### Name the entity controlling the work

For projects covered by NCG01, NC DEQ says the permittee must be the same entity as the financially responsible party on the approved erosion and sediment control plan; an outside consultant cannot submit as permittee. Identify the owner, contractor and financially responsible party in the quote file.[^1]

### Disturbance and phasing

NC DEQ applies the construction-stormwater program at one acre or more, including smaller work within a common plan of that size. Its erosion-plan instructions call for filing at least 30 days before disturbance unless an express pathway applies, and delegated local programs may be more stringent. Share the phasing and planned mobilization dates.[^1][^3]

## Who Regulates Insurance in North Carolina

**North Carolina Department of Insurance.** The North Carolina Department of Insurance administers insurance laws, licenses insurance producers and companies, reviews insurance filings and handles consumer complaints. The Commissioner is elected statewide.[^4][^5][^6][^7]

- Phone: 855-408-1212

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 5% of gross premium, less return premium, plus 0.4% NC Stamping Office fee for ordinary filed placements When North Carolina is the insured’s home state, surplus-lines tax is 5% of gross premium less return premium; ordinary broker-placed filings also carry a 0.4% stamping fee, while risk-purchasing-group and independent-procurement filings follow separate procedures. A diligent search is generally required; an exempt commercial purchaser may bypass it only after the broker discloses the admitted-market protection difference and receives the purchaser’s subsequent written request. The policy warns that the state guaranty or solvency fund will not pay surplus-lines losses.[^8][^9][^10][^11]

## Providers With Documented State Licenses

No provider in Spot’s research documents both a state license record and this coverage line. This does not establish that providers are unlicensed. [Check the regulator’s license lookup](https://www.ncdoi.gov/licensees/insurance-producer-and-adjuster-licensing) and confirm availability with a provider when requesting a quote.

## Questions to Ask Before You Buy in North Carolina

1. Is the site in one of North Carolina’s 20 coastal counties, and which CAMA permit class applies?
2. Who is the financially responsible party on the approved erosion plan, and will that same entity control the stormwater permit?
3. What is the full common development plan, land disturbance, work sequence and site mobilization date?
4. Which materials, existing structures and temporary works are included in the project value and quote?

## Builders Risk in North Carolina: FAQ

### Does every coastal North Carolina project need a major CAMA permit?

No. CAMA has major, general and minor categories, with some exempt work. Single-family homes require minor permits; the major category has separate size and other-permit triggers.[^2]

### Can a consultant be the NCG01 permittee if the owner is financially responsible?

NC DEQ says the permittee must be the same entity as the financially responsible party on the approved erosion plan, and an outside consultant cannot submit as permittee.[^1]
