# New York builders risk: NYC thresholds and code jurisdiction

New York’s construction-stormwater threshold changes by location: NYC’s East of Hudson watershed has a 5,000-square-foot trigger, and NYC also has municipal-boundary thresholds for disturbance and impervious area. The 2025 Uniform Code became fully effective statewide on December 31, 2025, while New York City may use its own building code. ## What to Watch for in New York

### The site can change the disturbance threshold

NYSDEC lists a statewide one-acre construction-stormwater threshold, but applies a 5,000-square-foot threshold to sites in the New York City East of Hudson watershed. Inside NYC, it also applies at 20,000 square feet of soil disturbance or 5,000 square feet of new impervious area. Agricultural, certain silvicultural and routine-maintenance exceptions remain.[^1]

### New York City uses a separate code path

New York State says New York City may adopt separate building codes; other municipalities generally administer and enforce the Uniform Code locally. The 2025 statewide code became fully effective December 31, 2025. Identify the actual local building department and applicable code edition for the project.[^2]

### Current authorization and start dates

The cited DEC permit, GP-0-25-001, became effective January 29, 2025 and expires January 28, 2030. Provide the broker the site-work start date and current construction phase, then ask when the policy begins and how materials, existing structures in renovations and early occupancy are treated.[^1][^2]

## Who Regulates Insurance in New York

### Does New York use a one-acre stormwater threshold for every project?

No. DEC describes a statewide one-acre trigger and lower NYC-area triggers. Confirm the parcel’s location, disturbance and impervious area, and any applicable exception.[^1]

### Does the New York State Uniform Code apply identically in New York City?

No. The Department of State says NYC may adopt separate building codes and directs code questions to its building department. The statewide 2025 code is fully effective outside that distinction from December 31, 2025.[^2]
