# Builders Risk in Kansas

Kansas law excludes builders-risk policies covering property under construction from the valued-policy rule and says insured property is valued at its actual value at the time of loss. Kansas also excludes builders risk from the statutory definition of a controlled insurance program, so verify the project's policy and valuation terms directly rather than assuming a wrap-up or stated limit settles them.[^1][^2]

Builders risk protects the project you are building, including materials meant for it, against physical loss until construction ends. The gaps that cost owners money are materials in storage or transit, the existing building in a renovation, and coverage ending when you occupy early. ## What to Watch for in Kansas

### Document value as the project changes

K.S.A. 40-905(b)(2) says a builders-risk policy covering property under construction is outside the valued-policy provision and that the insured property value is its actual value at the time of loss. Keep a dated project-value schedule for completed work and materials, then ask the broker how the policy defines, updates and adjusts the insured value.[^1]

### Do not assume a construction wrap includes builders risk

Kansas's controlled-insurance-program statute describes those programs as liability or workers' compensation coverage and excludes builders risk from the program definition. If a project uses an owner- or contractor-controlled program, identify the separate property policy, named insureds and responsibility for arranging it.[^2]

### Ask how partial losses and materials are valued

The statutory statement addresses value at the time of loss; it does not establish that every loss is covered or decide how a policy values each category of property. Ask for the form's valuation basis for installed work, onsite materials, transit and temporary storage, and how deductibles, limits and completion changes interact.[^1]
