## What Is Builders Risk?

Builders risk protects the project you are building, including materials meant for it, against physical loss until construction ends. The gaps that cost owners money are materials in storage or transit, the existing building in a renovation, and coverage ending when you occupy early. ## What to Watch for in Alabama

### Map each Alabama job site

Alabama’s floodplain office works with FEMA and local communities on flood studies and mapping, and provides an address locator and access to current FEMA maps. Check each project address and share the map and elevation information with the broker; a map identifies flood hazard, not what the policy will pay for.[^1][^2]

### Separate flood exposure from policy terms

Alabama’s state floodplain program covers compliant development as well as mapping. For a site in a mapped hazard area, ask the broker to identify the policy’s treatment of flood and surface water, any separate flood placement, and how materials and work in progress are valued. Do not treat participation in the NFIP mapping program as evidence that builders risk covers flood.[^2][^1]

### Check whether the map is being revised

ADECA’s program includes FEMA map-change resources, including Letters of Map Revision. If project plans, grading or new studies differ from the current map, ask the local floodplain administrator whether a map revision is pending and give the insurer the current approved site documents.[^1][^2]

## Who Regulates Insurance in Alabama

**Alabama Department of Insurance.** The Alabama Department of Insurance oversees insurers and licensed producers, reviews insurance filings, and takes consumer complaints. ### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 6% of taxable surplus-lines premium Alabama’s 6% tax applies to surplus-lines premium when Alabama is the insured’s home state; until the state’s multistate compact clearinghouse is operational, Alabama guidance says 100% of the premium on a multistate policy is taxed here. Separately charged policy fees are taxable. Surplus-lines policies do not receive Alabama guaranty-fund protection if the insurer becomes insolvent.[^6][^7][^9][^8][^12]

**Alabama's diligent-search rule has two exceptions:** A broker generally must make diligent effort before a surplus-lines placement; Alabama guidance says three declinations satisfy it. For an exempt commercial purchaser, 15 U.S.C. § 8205 removes that search only after the broker discloses the admitted-market protection difference and the purchaser then requests placement in writing.[^8][^10][^11]
