## What Do Marketing Agencies Need From Professional Liability Insurance?

Your work is public and made for someone else, so claims come from two directions. A client says a campaign, deliverable or recommendation cost them money, and a third party says something you published is theirs or harms them. One insurer's professional liability page lists negligence, misrepresentation, inaccurate advice, libel or slander and copyright infringement among the claims it covers, and uses a copyright claim over an advertisement as its example. General liability will not fill the gap for an agency. In the ISO CG 00 01 12 07 specimen, personal and advertising injury cover does not apply to an insured whose business is advertising, broadcasting, publishing or telecasting, or designing or determining website content for others. The same form excludes injury arising from goods or services failing to conform to a statement of quality or performance in your advertisement. Endorsements on your policy can change this, so a general liability policy that lists advertising injury is not proof that it answers your agency's claims. ## Which Professional Liability Exposures Do Marketing Agencies Face?

Your creative can carry someone else's rights. In a carrier's specimen professional liability policy, claims based on infringement of a copyright, trademark, trade dress, trade name, service mark, title, slogan or patent, or theft of a trade secret, are excluded. Another insurer's page lists copyright infringement among the claims it covers. Carriers differ on this, so the wording of your quote matters more than the product name. Campaign compliance is your problem as well as your client's. The FTC's Endorsement Guides say advertising agencies and public relations firms may be liable for creating or disseminating endorsements with representations they know or should know are deceptive, or that lack required disclosures, including by hiring and directing endorsers who fail to disclose. The FTC says that hiring another company to send your email does not transfer your responsibility under CAN-SPAM, and that both the company whose product is promoted and the company that sends the message may be held responsible. Get a written answer on whether copyright, trademark and slogan claims are covered, sublimited or excluded, and whether a separate media liability policy handles them. Test your client indemnities against the policy. The specimen excludes liability you assume under a contract unless it would have attached without the contract.
